Calling all attys,paralegals, or anyone thats been through it

Thanks for taking the time to stop and read this. I have a quick question, but before I ask it let me first give you a little background.
 My ex and I split and I took him for support since he wasn't doing his part to care for our child. In retaliation i was then sued for custody
and fought it tooth and nail because I knew it was being done out of spite and not in the best interest of our son. Long story short, I have sole
custody with the understanding that i had to drop support as to our agreement in our custody stip. My ex hasn't contacted me in quite some time and I really
want to change my sons last name to mine. So here's my question....Do i need to get my ex's permission before doing so? Or can I just submit a copy of our
agreement and the change I'd like to be made?

  • Ok, then I can't help you. I only know the laws in my state, Wisconsin. Which are yes, you do have to notify the father if the child is under the age of 14. After that the child can petition the court on their own.

  • In Michigan there has to be absolutely no contact for something like 2 years, and jail/prison time doesn't count.  Otherwise, BD would have to agree to it.  Stupid laws.
  • Thanks for your help ladies! Its completely ridiculous that you would have to get the BD permission when they clearly stated they don't want to care for the child... I wish the laws would change a little
  • Here in Ohio, I was able to petition the court to change my daughter's last name even against her father's wishes, and the magistrate ended up ruling in our favor. I had to demonstrate that it was in her best interest. It probably helped that her father didn't show up for court that day.
