maternity leave questions!

Hey mom's out there! So this is my first little one so I'm a little unsure about this question and not many people know the answer either .... how is mat leave based? I am full time but because I've been sick with my pregnancy and my job includes heavy lifting I'm now only 3 days a week....so is it based what I make now or what I made based on my employment Stat? Thanks!

  • I think this question is something you will have to ask your HR dept. I don't know your company's policy on their maternity leave. My company doesn't have maternity leave so short term disbabolity takes over. Not sure if your company offers that, but I'm pretty sure you have to be a full time employee to get STD. I don't think 3 days a week is considered FT. Just check with your company for an accurate answer and on their maternity leave.

  • You should speak to your human resources department, they can answer for your specific job.  I don't know anyone who gets a paid maternity leave, if you are using accrued time I guess it depends on your company policy, but I had a girlfriend who was full-time but used her vacation time half a week at a time, and her company allowed it.  you're job can't fire you for taking a maternity leave, whether you are part time, full time or per diem. 
  • Lol believe it or not I don't have an HR department (n) I'm like ems but it's a smaller company that does it... and yeah I know for sure we get paid mat leave just wasn't sure how it worked exactly but Tha KS for the input ladies it's appreciated :)
  • I work in EMS as well but for a very large company. We don't have technical maternity leave so I will be going on disability at 20 weeks per dr's request due to the lift restrictions and just general safety. Check with someone at your company for what is offered, but the way it works for me is: short term disability for the first 3 months (this was an optional benefit paid by employee, but we were planning this pregnancy so that's why I've had it), then long term disability kicks in after 3 months (this was employer paid). Disability generally covers 2/3 of your normal check. Make sure you submit fmla paperwork as well if your company is big enough to fall under fmla requirements. I'm not sure if you will or not based on the fact that you don't have an HR department.

A lot of places your qualification for FMLA depends on the length of time you have been employed(usually 1 year), and hours worked. If you meet both of those you qualify for the FMLA, if your company pays you for that time off that's awesome, most places don't.
    Also, note that FMLA doesn't apply to companies under 50 employees (not sure how small your company is). If your company does offer paid maternity leave, it's not really an issue (unless they don't give you 12 weeks' worth of leave and you really wanted to take unpaid time to stretch your time off until 12 weeks--in that case, FMLA would allow you to do so).

  • Thanks ladies!!! ... yeah I know I can file for 15 weeks "sick keave" bc of the weight restrictions but we are very small so we wouldn't meet the requirements for fmla. ... random question but are you guys from Canada? Reason I ask is bc I am and everyone I know gets paid mat leave unless you've been at the place of employment for less then 52 weeks or 600 hours
  • Nope, in the US. And it sounds like most of the PPs were, too. 

    If you're in Canada, you've got it made. Don't you guys get, like, 12 months paid leave?
