Question for our HR ladies

My husband was out sick for 3 days last week with a horrible stomach flu, and had comp time saved up for it. However, today his boss hands him his paystub (he gets direct deposit) and it's not showing any paid comp time; which he put in for before the pay period ended. He went to his boss and talked to him about it, finds out that his boss forgot about it and says that he "can't fix it because its all automated", and to make matters worse, his boss has left early today and is not answering his phone. 

Now, please correct me if I am wrong, but this is illegal right? Admitting to the mistake and refusing to fix it?  I am trying to get him to speak to his HR manager, but given the rocky situation they all are facing there, I don't know if she is going to be much help at speaking up and against the main boss. What else can we do that will keep my husband from getting fired because Nevada is a right to work state and he technically is still in his 90 day probate period? Any advice on this to best handle this situation is greatly appreciated. This whole snafu is screwing up our bills for this week.

  • Yeah id say that doesn't seem right at all. The days still probably count against him for attendance since flu isn't FMLA eligible (although complications from the flu can be) and he hasn't been employed long enough. But the HR/payroll department should have a policy in place to correct pay whether its from last week or 6years ago (companies are required to keep payroll records for 7years).

  • That's what I thought. And yes, I'm sure it does count against him, but to not correct the pay is ridiculous! It's not his fault his boss can't keep their payroll records straight, so why should we have to suffer, you know?

  • I totally agree! I'm sorry his boss is being such a jerk! Talking to HR is his best bet.

  • It does have to get fixed but the timeline maybe different for different jobs. My current HR department would fix it same day they are notified, my last job would give you the missing time on the next pay check. Also be sure 100% that he is entitled to comp pay for sick time while still on probation. His boss may not have given the correct details.
