Not bump related but stressful >.<

I'll make this as short as possible to avoid further annoyance.
Hubby has kids from previous marriage.
Money is withheld from check every week for child support. (or so we thought)
Hubby gets served by constable and court date for not paying child support?!
Look at past check stubs and compare how much has been taken out for support
and how much the paperwork says has been paid...
Basically only 2 payments have been made, but our money has still been going somewhere?
Works for a privately owned mechanic shop.
Thinking the guy has been taking the money out, but not sending the payments.
Thoughts? Any legal ladies, or someone well read that can give insight?

  • Does the paycheck show that the amount was taken out?  My parents own a business and trained me on payroll when my mom had surgery and one of their employees has child support taken out of each paycheck.  It is then the employer's job to make the money transfer.  If that amount is still coming out of his paycheck every week, then this should come down to the employer's fault, not your husband.  You'll just need some way to prove it I think.

  • It's the employer's responsibility. It seems like it's clear from the pay stubs that the money is going somewhere so if there is a mistake (or fraud), the employer is the one on the hook. Notify the employer now to put them on notice so they can look into it. 
  • agreed with the above pp's. But I would also call whatever office notified you as soon as you have contacted the employer. You want to make sure it is documented with the court that you have been making payments and you are trying to rectify this situation now before it gets worst. good luck!
