I know the norm for singleton is 6 weeks, but didn't know of it was different for twins, and different for c sections vs vaginal? Update: I should've been more clear: I have short term disability and they will only pay for what the doc says I need off. Completely separate from FMLA

  • Vaginal birth is typically 6 weeks and csection typically 8 weeks. If you need time off before bc of bed rest or another medical reason, or additional time after, you may need additional paperwork and/or use that within your 12 weeks of FMLA if you qualify for that.

  • Federal law governs time off of work not the doctor.  The only difference of time for C-section vs. vaginal is if you are eligible for short term disability payments.

Under FMLA, you are eligible for 12 weeks of non-paid leave.  This can be taken before or after delivery.  For instance, I had to use 6 weeks before the boys were born because I was on bedrest, so my company was only legally obligated to hold my job for me for 6 weeks post-birth.  However, they understood my situation, and I didn't return for an additional 4 weeks.  None of this was paid.

D & L are here at 34 weeks 4 days by vaginal and breech delivery on 11/19/2013
Two healthy boys weighing 4 lbs 15 ozs and 4 lbs 5 ozs.  Only 6 days in the NICU and getting bigger, stronger and cuter every day!
  • As an addendum:  depending on what state you live, there might be additional time/paid time for which you are eligible.  I think NJ, MA and CA have better maternity laws with additional benefits for multiples.

NJ has state-funded STD for maternity leave (60% of your salary up to a certain amt, then it's a flat amt regardless of pay), but no additional benefit for multiples. 6 weeks for vag, 8 wks for c/s

  • Personally I would tell the doc that and see how long I can get off till I meet the cap on the short term disability.

  • I had short term also and was only able to get off what the Dr. said was needed. I ended up getting to give me an extra 2 weeks, so 8 weeks total.
  • There are stipulations to FMLA such as having worked for your employer for 12 months, they must have over 50 employees, etc. If you do not meet these qualifications, you can certainly take leave but your position is not protected under that law.
