Real Estate Question - Not BOTBR

We've been house hunting and have our eye on a certain house.  We already liked the price and were getting our ducks in a row to write an offer when the listing showed a price drop of about $20k.  Our realtor talked to theirs and he said "The owners don't know I changed the listing.  We won't actually take an offer that low.  I just wanted to spark some more interest in the listing."  

I think it's shady, but I don't care enough to make a big deal because I want the house and the orig. price was already what we're budgeting for.  Plus, I always view real estate listing prices as a jumping off point for negotiation, definitely not set in stone.

MIL, on the other hand, thinks we have grounds for lawsuits, etc.  "It's bait and switch!  It's false advertising!  Totally illegal"

To be clear, we're not pursuing any legal action, but I was curious what anyone else thought.

  • It is not legal for the agent to alter the listing price.  I'm not sure how an agent would attempt that.  The owners would have to see it.  

    Did your agent give any advice?  I would put an offer in at whatever you feel is appropriate.  Most people don't sell for listing price but above or below it.  
  • Her advice was to put an offer at the orig. price, which we're fine with, because it will probably end up there anyway.  I think we will let the realty co. know what this agent is doing, though.

  • What the hell?  That's shadier than shady.  

    I would have offered low.  It almost seems like the realtor was trying to start a bidding war.

  • Not unusual around here, except for the part about keeping it secret from owners. The rest is par for the course. Slimey though. I think @CALEO might be on to something, too.
  • Well, it's probably all for naught.  They took another offer before ours was inked.  We will probably still put in a backup offer at the lower published price.  Oh well, if it's meant to be, it'll happen.  In the meantime, back to the drawing board.
