Please help!! FMLA question

Hey guys!!! So I am covered for 8 weeks and brought the DR order to my work.. I was planning on taking 2 more weeks, since I'm on FMLA. I understand I will not get paid for those additional 2 weeks but I am allowed to just take them. Do I need anything from my dr ?
The problem I have is that the HR lady at my work is a pain to deal with but she told me I cannot take those additional days/weeks.
Please give me any kind of info you ladies have!!! Would be greatly appreciated ;)

  • Does your work place qualify for FMLA? More than 50 employees, and you've worked there the required amount of hours in the last year? Have you read the law for your state and your employee handbook?

  • My company does not qualify for FMLA (we're too small, only 35 employees) but I took the 6 weeks from my Dr (Maternity leave) plus an additional 6 weeks PFL (Paid Family Leave). Our HR lady tried to tell me that I couldn't take that either, but after looking into it some more, it turns out I can get it. I didn't need anything from my Dr., but I needed to apply online.   • Yes, my company has well over 50 people and I've met the appropriate amount of hours.
    Can I still take those extra weeks..
    It stated in our handbook up to 12 weeks, and everyone has told me that I could so im not sure why she is saying this now! Confused!!!
  • If you are covered by FMLA, tell her you will be taking the 2 additional weeks that you are entitled to by law.

  • Your HR lady sounds like she needs a new career. If you and your company qualify for FMLA then you can take up to 12 weeks off to care for your baby. Provided you haven't take FMLA within the past year?
  • Unfortunately if the doctor paperwork says 6 wks then that is all that you have the FMLA for. If you want 2 additional weeks talk to your pediatrician and tell them you are concerned about being able to continue breastfeedong due to supply issues. They will fill out the FMLA paperwork for the additional weeks to help you establish your supply. (This is the advice I give my female employees when they want to take additional maternity leave and it almost always works)
  • You still need a dr's note for the additional weeks off. FMLA can't be used just because you feel like it.

    I have never heard this before.  Wasn't how it worked at my old company or at DH's company.  Sure, for STD payments while on FMLA leave you have to have a doctor say you can't work, but FMLA doesn't require that you personally have a medical issue with yourself.

    Caring for an infant is enough of a reason to be eligible - Dads and adoptive parents are all eligible for unpaid time off under FMLA provided that their employment/employer qualify.

    ETA: Text from the DOL website about FMLA: "The Family and Medical Leave Act (FMLA) provides an entitlement of up to
    12 weeks of job-protected, unpaid leave during any 12-month period to
    eligible, covered employees for the following reasons: 1) birth and care
    of the eligible employee's child, or placement for adoption or foster
    care of a child with the employee;"
