question about mediation

Hi Ladies!  I have a friend who could use your help.  Currently she and BD do not have a CO.  They are working on one (with lawyers), but aren’t able to agree on the terms.  Lo is about 1 year old (in case that affects your answers).  Her lawyer is suggesting private mediation, but she’s unsure what that means and entails.  Do the lawyers do the talking or is it her and BD?  Are lawyers present, and if not, how do issues get resolved if she and BD can’t come to an agreement?  She and BD have already tried counseling, and it did not help at all.  How is mediation more effective (if it is)?

  • @JMPrice,  Thanks!  Did the mediation take place on just one day or did your DH go multiple days?  Does the court assign the third party lawyer, or are you responsible for finding one?

  • Mediation was different for me. They took exand I into one room with one mediator. The mediator asks what issues each party wants to address then works through the issues one by one. I'm uncomfortable around ex and exs attorney chose the mediator. It became very clear that the mediator was very pushy and when she told me to shut up i walked out. A paper was drawn up and sent to the court and each party and all it said was who the mediator was, each of our names and that we didn't come to an agreement. No attorneys were allowed to be present and no other support system was allowed to be present. Mediation only takes one day unless you and the other party agree to continue through mediation.
