Trouble TTC

FMLA Anyone?

I was wondering if anyone else is on FMLA leave intermittently through this "adventure?"

Here is my problem, I am getting behind in my treatment/appointments/blood work. I work full time and my boss is just being very unreasonable. I am currently going to an RE, endocrinologist, and have been referred to a nutritionist and metabolic testing. My endocrinologist also wants to refer me more or less to fat camp and if I dont lose some serious weight soon they are going to work with my family doctor to send me for a sleep study because they think I have sleep apnea. I have blood work every few weeks, all the ultrasounds, and it is just too much. I am burning out being at the doctors all day and working back to back 12 hour shifts on top of spending the day with vampires and probes.

My HR department is very willing to work with people on FMLA leave I just wasnt sure if any of this would qualify. I am exhausted and very sick and really need the time to get better not just for TTC but for me personally.

  • This should all be covered by FMLA.  They have to allow you to take the time off that you need and guarantee your position as long as the company has more than 50 full time employees. The only trick to it this is that they do not have to pay you for any time off work.  Work with HR and make sure that you get all of the proper paperwork filled out.

    It is hard to deal with and this is not the needed stress that you need with everything else that you are going through.  Good luck and lots hugs to get you through!!

    01/2014 Large Cyst Removed along with right ovary and tube
    04/2014 2nd HSG-Remaining tube damaged/blocked
    05/2014 Testing cycle and BCP to prep for IVF
    06/2014 IVF cycle #1 is scheduled cancelled due to low estrogen
    07/2014 Started Estrace to help with my estrogen issues
    08/2014 IVF cycle #2 is scheduled delayed
    09/2014 IVF cycle #2 is scheduled failed- 6 follicles, 1 retrieved, 0 fertilized
    10/2014 WTF scheduled for 10/22 and second opinion scheduled for 10/10
    11/2014 Moving on to the new RE!  
    01/2015 IVF cycle #3 is scheduled delayed
    02/2015 IVF cycle #3 is scheduled

    Aug 2013 - SA: Counts & Motility = great, Morph = 1%; RE didn't seem too concerned

    Me: 26
    Jan. 2014 - Blood work ordered by obgyn:  Prolactin = high & AMH = low (0.73)
    Feb. 6, 2014 - Repeat blood work ordered by obgyn:  Prolactin = normal & AMH = low (0.9)
    Feb.  20, 2014 - First appointment with RE
    Feb. 24, 2014 - HSG scheduled;  DX:  one tube definitely open & one tube could be blocked
    Mar. 7, 2014 - CD 21 Blood work for Progesterone; DX:  Progesterone level at 5.2; shows I ovulated but was low
    Mar. 28, 2014 - Laparoscopy; DX:  Tubes open.  Found some endometriosis and had that removed.
     
    History:
    Started TTC:  June 2012
    June 2012 - March 2013:  When it Happens/it happens method = BFN
    March 2013:  Started using Fertility Friend
    Cycles 1 - 15 with Fertility Friend = BFN
    Cycle 16 - Benched due to Laparoscopy
    Cycle 17 - Natural Cycle = BFN
    Cycle 18 - Natural Cycle = BFN
    Cycle 19 - Natural Cycle = BFN
     

    Current Cycle:
    Cycle 20 = Natural Cycle

  • What state are you in? CA has some additional options for you if that's where you are. I work in HR so hopefully I can be of some assistance ;)

    You probably already know this - I apologize if this is all repeat information.

    Your first step is to discuss with your doctor. Make sure to bring your FMLA paperwork with you and be prepared to make your case with your doctor (they are the ones to decide if you need this time off of work). Once your doctor has filled out and signed off on your FMLA paperwork you can present it to your HR department - they are legally required to follow what your doctor says, and protect your position and benefits for up to 12 weeks while you're gone (as long as you have been with the company for at least a year and worked 1250 hours in the last 12 months - and like ChristieH said, you need to be employed by a company with at least 50 employees within 75 miles of your location. Also, like it was already mentioned, they aren't required to pay you.

    You may want to consider exploring options of taking an intermittent FMLA leave of absence. Your doc might be more on board with it, allowing you to take every other Thursday off or something similar. This might be best for everyone? Just a thought.

    Really hoping the best for you. I'm not a huge expert on the doctor side of things but just know that there are laws there to help you!! ((hug!))

     

  • Thanks sorry it took me awhile to respond.

    I am going to get the paper work and talk to my family doctor about an intermittant leave this afternoon. I have been at my company for 4 years and its the largest healthcare system in my state. I am ok with not taking pay, I just need to get caught up on all my treatments and obligations. It is just too much on me.

  • It should be covered. Talk to your boss and an HR rep. Keep in mind, you typically need a lot of doctor notes/explanation to make sure it's legitimate. Good luck!

    My mom has been telling me to do this for a while but they terminated a woman for it before. Of course they did it because they said she wasn't able to complete her job duties while on fmla so im leary about it

    Sadly, my work will not approve me for intermittent FMLA. They state infertility is not a qualifying condition, although once I'm actually pregnant they would be happy to approve it. Now the hard part is actually getting pregnant.... I'd recommend at least talking to your doctor & submitting the paperwork. I think it's better to have it in place just in case.
