Intervening?

Has anyone ever intervened in a CPS case? Looking for a general idea of what to expect with everything, cost, etc. any experience would be appreciated.

  • I don't think I understand what you are referring to. Intervene in what way? If you have information concerning an open CPS case you can always provide that to the agency. It wouldn't cost any money.

  • Are you talking about calling CPS on someone? Adopting from foster care? Something else?

    Calling CPS to investigate shouldn't cost you anything. Adopting from foster care is significantly cheaper than other adoptions, but will require you to take time off for Court dates and possibly medical/therapy appointments if necessary. The exact costs differ per agency and situation.

    Sorry, maybe this is a state by state thing. A foster parent in Texas has legal standing at one year to intervene in the case, petitioning the court for termination of parental rights as well as adoptive placement. From what I have heard from other foster parents, it can be extremely costly, as you are essentially paying for an entire trial and legal representation. One friend's cost upwards of $40,000 to get adoptive custody of her son. I know that not all cases are that complicated, but can be. In our case, once we have foster son a year (in Aug.), we plan to either file for adoptive placement, or mediate with the parents to see if they will agree to a semi open adoption. I already know that their rights will be terminated in July, but the state has pending home studies on 2 relatives that have never met him and I don't expect those studies to be done by then. No one else involved in the he case believes that is in his best interest. Sorry if this was even more confusing..I'm still trying to navigate the whole legal system, which I'm sure varies from state to state. I just secured a consultation with an attorney next week to go over options and recommendations, but wanted to see if anyone else has had any experience similar to this.

    Yes, the TPR date is set in July. Parents haven't done services and don't have the resources or mental health stability to raise a child..she doesn't have her first child either. Mom has mentioned several times that she only cares about him knowing his Dad. She has even offered to leave the picture if dad had a chance to get him (which he didn't) that's the only reason I would mediate and offer a semi open adoption. We do have a good working relationship with them and I know they really like us, which they have told everyone. Of course, mediation would happen with attorneys, and a legal agreement would try to be reached, but I don't even know If that's the best course of action or we should just try to file for placement. That's why I'm talking to an atty. Of course it's CPSs job to place with family no matter what, but if a foster parent has legal standing and has everyone else involved on board (ad litem, casa, etc), it ultimately comes down to the judge.

  • I would ask your FAD Worker and the child's Caseworker if they would advise doing so. You might wait to see what happens with the termination. FYI I think Texas mandates that the attorney can only charge you $1,500 for the actual adoption work, but I don't know about filing an intervention.
