Working during FMLA??


I am planning on taking 4months of FMLA when my twins come. In addition to my regular full time job I also have a little part time job with a different company. I would love to continue with a few shifts at my part time job during my leave from my full time job. Is this legal since it is technically disability leave?? I live in Mass.
Me:35,  DH: 39   
TTC since March 2011. All bloodword, SA & HSG are normal.  
8/12: Clomid & TI - BFN 
10/12: Colmid & TI - BFN 
3/13:  Clomid, Trigger & IUI - BFN 
4/13: Gonal F, Trigger & IUI: BFN  
6/13: IVF #1 (1AA blast & 1BB blast) = BFN 
8/13: FET #1= BFN
10/13: FET #2= BFP!!!

  • CourtandNate MA has 16 weeks unpaid protected leave for twins.
    In terms of working though, as I understand it, if you are getting paid disability leave of some sort, you aren't allowed to work. I don't know what the rules are for unpaid leave.

  •  FMLA isn't disability but if you DO get disability, you can't work at all during that time. You're being paid because you're unable to work.  I'm not at all sure how it works with FMLA so you'd need to ask your HR, I think.

  • You can't work at all while you are receiving disability pay. If you are on FMLA but are unpaid or using PTO, it will depend on your company policy.

  • Would the entire 16 weeks be disability or just the first 8 weeks? Perhaps you'll need to forgo your part time shifts for the first 8 weeks, or however long you're on disability, but once you're just on regular FMLA job protection - you are allowed to work, at least according to the federal law. Sounds like you're coming under an additional 4 weeks of protection through a state law, so I'd read that carefully before taking on work between weeks 12-16. But I did note any hours I worked during my maternity leave, since none of it was "disability" - it was just FMLA. If my boss asked me to do something that took at least half an hour of my time, I noted it in my time card as time worked.
