Super SS... forgive me...

Hey ladies, I know there are a bunch of us in NY State and I'm wondering if any of you could share with me your company's specific maternity/family leave policies? (Particularly if you work for a company that has less than 50 employees and is thus not FMLA eligible.) I am the first person at my company to get pregnant, so we're trying to figure out what the policy should be for me and future employees.

Also, good news for those of us that aren't FMLA eligible, the NYS Assembly just passed a bill entitling workers to 12-week paid family leave. Just needs to pass the senate to be final! FX!

    krptcmschfmkr128 - I don't know the particulars, and how exactly the law will be enforced - but I'd imagine that it "should" apply to all workers! 

    jmar2011 - I get so angry at our national family leave policies! For being such a strong, important country we certainly have it ass-backwards when it comes to protecting our workers!

  • I HOPE that bill is for all, paid leave makes all the difference!

    Our company is eligible for FMLA, but here is what HR/they provide and the rules:

    Full-time female employees will be eligible for up to 13 weeks of leave for the purpose of giving birth or adopting a child. Of the 13 weeks, 6 weeks will be paid leave; the remaining & weeks can be taken as vacation days, sick leave, and/or FMLA unpaid leave. 

    Full-time male employees will be eligible for 10 days of paid leave during the first month following the birth or adoption of a child.

    In order to qualify to take family or medical leave under this policy, the employee must meet both of the following conditions:

    The employee must have worked for *** for 12 months, or 52 weeks. The 12 months need not have been consecutive. For eligibility purposes, an employee will be considered to have been employed for an entire week even if the employee was on the payroll for only part of a week or if the employee is on leave during the week.

    The employee must have worked at least 1,250 hours during the 12-month period immediately before the date when the leave is requested to commence.

    Hope this helps in crafting a new policy. Even being a smaller company, hopefully they'll be willing to offer some paid leave.

  • NY here and work for a small company. I have to save all of my 3 weeks of vacation/sick time and use that. Then I can go on temporary disability (something like $150/week) for the remaining weeks I'm out which will likely be a total of 6-8 tops. I'm sure I could take 12 weeks if I wanted I just can't afford to do so.

    Very nice! So does this mean we would now be eligible for 24 weeks? as in 12 under this act plus the 12 under fmla?

    I hope this is in place by June although I highly doubt it

  • jenn72178 - that makes me so mad. Are you going to have to have your dr write you a note to collect temporary disability?

    lpetrillo - it's a good question! I sincerely hope it's in place by June too, but knowing how slow politicians are to react I'm not optimistic. At least those that come after us can benefit!

  • @abastian00 I have to read through the paperwork for the disability. I think I have to complete a form and make a phone call once the baby is here to collect. My DH is retiring to stay home with the baby so at least we have that going for us. Gotta look at the bright side :-) I have never had 6-8 consecutive weeks off in my life so I'm excited about that as little as it is.

    That's so great that you guys have the option to have your husband stay home! Let us know how the disability stuff ends up working out for you... I'd be curious to know!
