Michigan has a trial starting this month to challenge our ban, and I am pretty hopeful that after the recent precedents, things will go the right way.

At some point the Supreme Court is probably going to have to hear a case. Scalia will go through great mental gymnastics to try to justify why Gay Marriage is bad and banning it is not discrimination.

Of course, since it's the Roberts Court, they will do everything they can to avoid making a broad, significant ruling. Such as in Hollingsworth v. Perry (Cal Prop 8) where they basically just ruled the Prop 8 proponents didn't have legal standing to actually go to court. Good result, but weird ruling.

Missouri's ban is being challenged too. They are only asking for recognition of out of state marriages.

It was weird but I think it was legally correct.

So glad to hear the news about Virginia. I agree that ultimately the Supreme Court will be forced to weigh in, but given their own precedents in Lawrence v. Texas (striking down anti-sodomy laws) and last year's DOMA case, I think even Scalia will have a hard time arguing the constitutionality of same-sex marriage bans. And I think it's naïve to think the Court can completely put aside the increasing public support for marriage equality.

Ultimately I think this is what sways Kennedy. I don't think he has any interest on being on the wrong side of history.

Scalia and his pets will be against Gay Marriage no matter what, but Kennedy and the liberals makes it 5-4.
