NBR: Calling all Attorneys (LONG)

I write a blog and one of my photos and recipes has been repinned and shared several 100 thousand times. This recipe & photo was one of my first, and I didn't have it watermarked. There have been several instances where people have used both this photo and recipe w/o my permission and w/o giving me credit as I state must be done on my disclaimer page. I usually contact those people and ask them to either remove my material or link back & credit my site and everyone so far has complied.

Tonight I came across a blogger "chef" who posted both the photo and recipe on his blog and his FB page and claimed it as his own. He took down the picture, but told me he didn't believe it was mine and he refused to take down the recipe or give me credit for my original work. While browsing his pages it is 1000% clear both of his pages are nothing but reblogged images and recipes that he has found on Pinterest and is claiming as his own. He also has over 30K followers who believe these recipes are his!

Is there anything I can do to shut this guy's site down? I filed a complaint with FB, Google, & Go Daddy, but since he took down my photo I'm not sure if they will do anything. How do I get the sites to realize that he "chef" is stealing other peoples photos and recipes and claiming them as his own?

    Can you google where he stole the other recipes from and get other bloggers to back you up? Power in numbers?

  • Do you have some sort of evidence to show when you originally posted the photo and recipe online?

    You do have some protection under the concept of "actual use," but you would have to be able to prove that you were using them first. Likewise, you will probably need to show that he was using them after your first actual use.

    I have the original blog date posted online which was May of 2012. I also have the original, unedited photographs with a time stamp also.
