That cute little apartment that I had before my latest move? I knew it was too good to be true. I turned the keys over on September 12th. Still no deposit back. She told me that funds did not come thru as expected and she would pay me end of October. Still no check. I am pissed. Come Wednesday I am filing. I hate this crap. Pay me my money.

  • That sucks. It took three months to get our visit back after we moved out of our last place. And when we finally got it back, they cut it because of damage that they said our dog must have caused (damage that was documented upon move in) and because they said the stove wasn't clean (we had to scrub it like crazy when they replaced the original one when we were hit by lightning and it was lined with foil so it was clean) and they said they had to clean the whole place (I had to scrub the whole house from top to bottom when we moved in and then I scrubbed and rug doctored my already clean house before we left, even windexed the windows).

    Landlords can be real dicks sometimes.

  • The only time I didn't get a deposit check was in Texas and it was damage that XSD caused.  I will get this. I have an email from her stating she was very pleased with how Ieft the place.

    On a happier note...I got my last commission check from my previous job.  Almost $2K! 

    I need a couple hundred, but the rest is going to mom and dad.

  • Sorry you have to take them to court to get it. That's just a huge PITA.

  • That sucks. I would give the lady one last chance, letting her know that you will be going to small claims court if you don't get a check by x date.

  • Nope. Normally I am that nice, but  I have had it with being nice to people. I always get screwed.  I thought about it but last month I had to contact her FOUR TIMES before she responded to me the first time.

  • How long can she legally hold the deposit? Every state is different but when I had apartments in Maine I always got it back within 30 days , and then in NH they can hold it for 90 days and they held it the full 90 before returning it.

    It is typical for a landlord to give it back immediately after move out inspection.  But 30 days is the rule.

    I may wait until the 15th to file, but that's as far as I go.  She committed to paying me end of October which is beyond the standard 30 days.

  • I also have to take XH to court for life insurance. I'm waiting until after the holidays and...he also brought it up to me and he is looking into it again.  He better do it in the next few months.

  • Don't you have to pay at least a filing fee in small claims court? I would just email her tomorrow that you will file on 11/15 if you haven't received your deposit back by then. I just think an email will maybe get her to pay the deposit vs. wasting your money & time. After all, time is money.

  • Depending on what the laws are in that state you might be entitled to punitive damages from her as well for wrongful withholding of your security deposit.
