Child Support Arrears

So, say my XH owes something like 1500 dollars in back child support. The CS order was from when he had a stable job and was making good money, the arrears have occured since he lost his job and was unemployed and then took a job making less money. If he applies for a CS reduction, and wins it based on his new income, will the arrears still be owed in full, or will that reduce too since he lost his job a while ago?

  • The time he files is when the CS will be effective.

    So, if he loses his job in April and then doesn't file for a reduction until August, then April-August is on him and there's no getting out of it. However, if the reduction is finalized in October, then the lower amount is retro active to August. Does that make sense?
