Birth certificate

So my baby daddy didnt sign birth certificate and i gave my son baby daddys last name anyway....DUMB but now i want it changed to my last name and i told baby daddy about it and he got upset like really you refused to sign the brith certificate. ugh i just dont know if going throught the hassle with him to change if if hes going to fight it for no reason he doesnt even take care of him. i just dont know what to do. leave it his last name so i dont have to go to court and stuff cuz i work full time and take care of my son or should i fight it and get him my last name??? uugh.....

  • Ok, take a logical look at this. Do you think your child is going to want the last name of the woman who's always there for him or the last name of some unknown individual who wouldn't even stand up and say this child is mine? For BD to have ANY right to have a say on this topic he is going to have to claim your son, that means he'll have to pay child support. Until he takes responsibility he has no rights to weigh in on such matters. If I were you and he said something to me I'd tell him that when he signs the paperwork and is liable for child support you can talk until then this is your child and your responsibility so you have every right to make the choices you feel are right for your son. Most likely he's not going to want to establish paternity and therefore would have no voice in court. He'd have to prove paternity first I would wager but I'm not a lawyer. I would change it in your position. I don't believe you will have a fight but you will have to explain your reason to a judge. As long as its not fraudulent they usually approve. You may have to address that with the judge and have a plan in case BD does step up such as hyphenating his last name. I believe it would be worth it. The county clerk usually handles this.

    You've written TWO posts about it. So like PP said, you should do it. Who cares if he makes a fuss about it?
