It will depend on what state you live in the EM lives in and the laws of the state. There are four states that require agencies. MA, CT are two but not sure what the other two are. If an EM is from one of those states you will need an agency. Some states require an agency if you are going to pay any EM expenses. TX is one of those states, so I don't know the laws of every state but each one is different. I would recommend that if you do connect with an EM on a site like ParentProfiles that you talk to a lawyer first and then decide which is the best route to take, agency, lawyer or both in some circumstances.
