Company without a Maternity Leave plan

Hello,

My company does not have a formal maternity leave plan, and does not offer short-term disability. Each woman, when she becomes pregnant has to negotiate leave.  It's usually a combination of paid leave (by the company), using vacation/sick time, and unpaid leave.  Thanks to FMLA, my company has to hold my job for 16 weeks (in DC), but they do not have to pay me anything.  There have recently been some leadership changes in my organization and I'm concerned that since my boss was one of the people who left, that the CEO will punish me in his place (in the form of unpaid maternity leave).  Does anyone know if there is any law that states since my coworkers have gotten paid leave in the past (after being here the same amount of time I have been- 2 years- before becoming pregnant) that I should also get paid leave based on precedence.

Any help or guidance would be appreciated!

  • Sadly I doubt it. It kinda sounds like negotiating your salary and benefits....it's not the law that everyone has to have the same.

    I agree. I would consult with your HR department/person.

  • No, but you are super lucky that you have job protection for that long.
  • I'm confused...are you saying that they won't let you use your accrued paid time off or that they won't pay you some unofficial paid time that others have gotten in the past? They should let you use your accrued paid time off during your FMLA, but you'd have to check with HR. As for the paid time that doesn't seem to be on the books...sorry, sounds like you might be SOL.
