Text SENDERS in trouble?

Short story: NJ ruled that a person who sends a text to someone they know is driving can be held liable if the recipient crashes their car. WTAF?  How can anyone prove that a text sender knows someone is driving?  Personal accountability, nobody haz it.  Like if One Direction ran naked in front of the cars of a lot of you and you crashed into me, that's on you, not the nakeds.

  • When I know DH hasn't made it to work yet I will not text him. I either wait or use the text later app.
    That makes sense but my issue is, how would anyone be able to prove that you, with 100% certainty KNEW you were texting him while he was driving if you did?

  • My guess is the back and forth texting is the issue and that would easily be proven in court. If the recipient mentions driving and you keep texting, you're as guilty. It happened around here, some air head crashed into a pole and was blaming her ex for it seeing as he was texting her. Air head was DIU as well... The judge had a field trip with that one.

  • I am so done with seeing people texting while driving. How many people have to be maimed and killed because you have something really unimportant to text to someone else?

  • I admit to have texted while driving once. If you can call it that even. Red light, phone had been blowing off, checked what WWIII was happening for people to text me that bad, read my brother's message that our grand-ma was in the hospital.

    You've never seen someone turn into the first parking lot that fast.

    I don't get the urge to text someone while driving if you're able to freaking pull over and do your thing.

  • To be clear, I'm 100% behind no texting and driving, including reading them.  I can't get behind blaming the sender of a text when an accident occurs.  The driver bears all the responsibility to do or not do whatever is required to make sure they're operating in a safe manner.
