Just wanted to update you ladies. The toddler who fell in the pool at my DD's daycare is ok. No apparent brain damage or other issues. Ironically, the sitter probably saved his life by giving immediate CPR.
As for the sitter, social services have determined she was guilty of neglect due to lack of supervision of the kiddos. She didn't know they had gotten out by the pool, even though it was covered. The DA is still determining whether or not to file charges, possibly negligence or reckless endangerment. I think that's horribly tragic for our provider, who just made an honest mistake by leaving a gate open. Unfortunately, given the outcome, they probably will file charges. She could also face civil charges from the parents, and her license is still up in the air pending the outcome of everything else.
So we've found a new licensed daycare home in our neighborhood. Price is 5 more/day, but she takes the kiddos on outings and they have visits from a music man and some other people. The other kiddos are all around DD's age, which is cool too.
Anyway, thanks for the T and Ps. It's been a rough couple of weeks, but things are looking up!

That is such a tough situation. Parents, even great parents, make mistakes and oversights too. Hopefully, never at the expense of a child's health or life, but it is always sad to me when a good provider makes a mistake that anyone could have and then all of the sudden looks like they were toxic for children the whole time.
If this woman had a horrific track record, I would not be saying this, but it sounds like you were happy with her for your DD.
Of course, if something happened at my provider's house, I would pull DD out too, I am just saying mistakes, even fatal mistakes happen by decent, good people who love children. I feel for the child hurt, the family, and your provider. That is a life altering oversight. I am so glad the child wasn't seriously hurt or killed. So glad that you found another provider you are happy with.
