Nebraska HELP!

Hi there,

My partner and I are looking to start trying in about 4 months but want to have some things sorted/planned first. We are hoping to hear from other LGBT folks who have experience with this.

What's the best route for the second parent nonbio mom? Since second parent adoption isn't legal here, is guardianship an option without bio mom relinquishing her rights? What else should we know? The only other thing we can find is POAs/medical POAs updated every 6 months. One of our main concerns/goals is that our future kids might be able to get on her nonbio mom's insurance and the companies usually require that they've been adopted/have guardianship. HELP!

  • I'm in Texas, so I can't answer any of your questions.  Maybe there are some other Nebraska parents on here that can help answer your questions.  In the meantime, I would suggest you look for a law firm specializing in LGBT legal issues.  

    I don't know if Nebraska has a similar program as Texas, but my wife and I participate in the Texas Legal Protection Plan (TLPP) - it is kinda like a legal insurance.  We pay $17/month.  Our participation in the program entitles us to certain legal services such as name change, estate planning, POA, and second parent adoption (up to 25 hours).  We still have to pay filing fees and other types of fees, but it is saving us a bundle on the actual legal fees.  I was able to find a firm that specializes in LGBT legal issues and participates in the TLPP program.  It has been wonderful.  Good luck to you!

  • Thank you for your reply!  We are having trouble every step of the way - including finding an attorney that is well-versed in these issues.  I am able to participate in a legal plan through my job, but my partner doesn't have the option.  And since we can't be legally married, they won't cover anything for her under my plan.  Oh the irony! :(
  • It's no fun living in a state that enshrines discrimination, huh? :( I'm in Indiana.  I do believe we have second-parent adoption for unmarried couples, which is what we'd fall under.  But we're still going to go through a lawyer.  Have you tried looking at Lambda Legal?  They might have some resources specific to Nebraska.

    In any case, if we're lucky, within the next 10 years these ridiculous bans will be gone.  Good luck!

    I'm in Nebraska and have experienced a lot of things you have so I have some answers, but by no means all.
