Well got the official copy of the court order for establishing paternity last week.. Which is nice that its "official" now.. Glad I got a birth certificate in advance before they change it and add the father's name..
I'm kind of in this "hurry up and wait" phase and I hate it..
I guess they sent a financial paperwork packet for the father to fill out and now I have to wait for that to come in, and for them to decide how much of a payment he has to make every month... I have no idea how long this process takes but it seems like its taking too long lol.. I want it all to be done and over with so I don't have anything 'lingering' or have to be wondering how its all going to turn out
They told me that the courts will send an order to his work to take the money out of his checks once an amount is established, which is cool they don't leave it up to him to do it himself (or do they? i thought it was up to him to do.. ?) but its honestly better if they just take it out of his check because if not, my child wouldn't see a dime from his sperm donor..
I have a male friend who was just taken to court for CS and they told him he has to pay $500/month and I was surprised, He says he's fighting it.. I didn't know they could fight it? I had no idea they awarded ppl that much.. so hey maybe I'll get lucky- I was thinking we'd be lucky get $100 or $200/month ya know.. ? I wonder what is average..
anyways thats it.. what are your experiences with this type of thing?? any comments or suggestions?
Re: meh... some ramblings, cs related, would love feedback, thx :)
Anyway. I'm in the same boat as you.... Hope everything works out for you
CS is usually based on how much BD makes so the more he makes the more you get. Unless you make a lot more than he does.
One nice thing about doing it myself is I'm not changing the birth certificate. I have the paternity paperwork but they told me I didn't have to change the birh certificate, in fact that I couldn't because I hadn't requested it. That made no sense to me, but since it didn't affect the CS I left him off.
I filed initially in early january, so its been 7 months so far & who knows how much longer it will take, I'm just glad its been progessing this far
For me I filed the initial paperwork towards the end of Feb right after LO was born, so it's been almost 5 months. CS has been ordered but the order is waiting for the judge's signature. Then it has to be served and the withholding filed. Since they told me getting the signature could take a couple weeks, I'm still looking at another 2 to 3 months. Fun!
Did you ladies use an attorney?
I did not because BD wasn't actually fighting anything, he was just not helping anything either. I also didn't use Child Support Services because, in CA at least, they won't handle custody, just paternity and support, and I wanted everything done. It's been a PITA.
How long did it take your state to establish paternity? Where are you?
no attorney, i will be contacting one if he files for custody or visitation though.. im using cs services though. (I'm thinking chances of that happening are slim to none, if it does happen, its because he's trying to spite me or get out of paying full CS & I will fight tooth and nail to have him with no visitation no custody... yea yea get mad at me but ya'll don't know the whole story & I understand he has a right... If the state awards it, I will comply, but that doesn't mean I'll be happy about it.. )
its been 7 months since I've filed and the paternity test came back last month, the official court paperwork just came through.. it would have been earlier but 'someone' missed his initial dna testing date then rescheduled as far out as the case worker would let him.. lol
