DH just went to see his lawyer. They looked at the GAL notes from the last time. It states that she has to have a weekly drug test for 180 days. If she doesn't have a weekly drug test, will she really have to start over again? They are also asking that she pays attorney fees since she is the bringing this up for no reason. Further she is also writing her a letter asking her to send her the drug tests. If she doesn't send them, she will ask for the motion to be cancelled but it most likely won't because a petitioner can only cancel it.

The state usually takes into strong advise what the guardian ad litem (GAL) has to say. If the GAL notices that the mother is in need of weekly drug testing, and the mother does not comply, either with the testing or written proof of the testing, the GAL may enter a request that parental rights be terminated. The mother can request that the motion be cancelled...though, usually, to no avail, especially if she needed a GAL for her children in the first place. A Judge or Administrative Hearing Officer can officially can the motion...
