Special Needs

considering divorce

So this may sound crazy, and I'm only half serious, but DH and I are thinking about technically "divorcing" because of financial reasons.  DD has special needs but we don't qualify for a lot of services because of our dual income.  DH's job is almost 100% commission so he has good years and not so good years.  We budget accordingly.  I work part-time for benefits.  We have hit our out of pocket max the last 2 years.  When we have tried applied for respite care, TEFRA or medical assistance, we've been denied because of our income level.  It's very frustrating!  I get that the money is there for families who truly have the need, but I'm afraid that we will have to go broke before getting assistance.

I know we won't actually go through with this, but I'm wondering if anyone else has ever considered this.  Am I the only one who wonders how I'm going to pay for all her equipment and therapy???

Re: considering divorce

  • I didn't think that TEFRA turned people down unless you weren't considered a US citizen, since it's a government thing. TEFRA MA is based on your income and you pay a parental fee monthly. It is a secondary policy to your primary insurance. It can be expensive, but worth it if you're having a lot of out of pocket medical expenses. Another option you can look into that I have hear other people use is MCHA. I don't know a ton about it, but I think it also has a parental fee monthly.

Do you have a social worker that you're working with? I'm surprised that you weren't able to get respite care. There are also various grants depending on which county you're in (I can't remember at the moment where you said you were).

Are you working with a social worker?

TEFRA in MN is based on the child's income; unless you have settled significant assets in your child's name or allowed someone else so to do, they would qualify so long as they meet the criteria for disability.

Your state's Birth to Three Program is another resource for therapy.

TEFRA is based on the child's income, but when we applied we were told that while we did qualify, DH's and my incomes made our yearly deductible too high that we decided it wasn't worth it for us.  We are getting services through early intervention, which has been great.  We are not working with a social worker.  How would we find one?

  • We were put in contact with our social worker by our birth to three coordinator. I would check with you coordinator and see if they can refer you to a social worker. Then they can help you with anything else you might need help with. Even just having someone help you navigate through the different programs and services.
  • One more thought... You may want to look into TEFRA again. As a part of the tax bill that passed this legislative session, there was a decrease in the parental fees for TEFRA. Here is what someone passed on to me from the fiscal notes:

Jan 1, 2014 NO fees start for 275% of poverty level and below.

Reduced rates below beginning July 1, 2013:
276-525% of poverty level is a sliding scale of 1%-7.5% of AGI545-675% of poverty level is 7.5% of AGI675-975% of poverty level is a sliding scale of 7.5-10% of AGI975% of poverty level and over is 12.5% of AGI

Do you have a link with this information? I really hope this is the case, because I had estimated our TEFRA payment to go up a few hundred dollars per month starting in July. Tongue Tied

  • Here is one that just confirms it went through:

Here is a summary of what went into the bill:
