Update on drug addicted BM

DH got served on Friday, that in fact BM did file for supervised visits.  His court date is July 2nd. 

Ugh...

So my question is will we have to pay for another retainer fee since the other case was considered closed?  I know we probably will, just sucks because we are still paying for our attorney from the last time and we are paying the GAL fees for BM(until she takes him back to court, she is supposed to pay him back for it). 

So frustrating!!!

    Keep all your documentation, speak to your lawyer.

    I hope BM is in fact clean, has been clean, and can prove it. I hope she isn't going into court to waste all your time and $ if she hasn't done what the judge told her she needed to do in order to get visitation.

  • I'm really not sure... I honestly think that depends on your attorney. and I would definitely have your attorney push for supervised visits in a counselor's office, not someone of her choice.

    We had this issue when BM had supervised visits. when she did show up for them the "supervisor" would leave them alone for the visits or at least part of them.

    My DH's atty told him that he was going to push for supervised visits by one of SD's counselors or DH himself.

    This. and the judge should order a hair follicle test before making his decision.

    Me too!  Doesn't make sense at all.  She doesn't call for 2 weeks and then this.  DH keeps telling me it won't ever make sense.  He keeps saying, she is a drug addict, nothing she does will ever make sense, so stop trying to figure it out, you never will. I wish I could I think like that but I don't think I ever will. 

    DH is calling the attorney this afternoon.  Hopefully I will get good news that it won't cost us a retainer fee because if it does, no vacation for this family.  It will be worth it if he needs it but just kind of sucks.

    DH will only accept supervised visits at a facility.  Her father used to supervise but he would leave or let her leave with the kids(she doesn't have her drivers lic, it was suspended for unpaid tickets for 2 years).

    Def hair follicle, her twin sister used to do the pee tests for her.  Last time, we had to pay for the hair follicle, hopefully she will this time.

    I understand the concern of the cost of the hair follicle but it shows much farther back than a urine test, depending on what type they do they could tell you what she had for dinner 3 months ago. I would also have them request those on a regular basis or at least urine screens or even swab tests... I don't think there's a way of getting around that.  if in fact she does get anything out of this. :/

    The girls have gone through so much in their short life. We are finally in the groove of what we have(BM calls twice a week, we bribe them to talk to her and tell them every time that its okay to talk to her as I don't think they really know who she is, the last time she saw them was 18-19 months ago, they were 2 and 3).

    I don't know BM nor do I care to ever know her. DH had the kids while she was using(cocaine and herione) when I first started dating him.  They have been pretty much with us since we were together.  I hope for her sake she is sober and doing this for the right reasons.

    We have to pay a new retainer fee every two years. On all the papers our attorney files it has something that says his 'commission expires' on X date. Not every attorney may be that way, and I believe if our current case was ongoing, it would not be an issue. But since our last case was technically closed in 2010, we had to pay a new retainer when we filed.again this past February.

    So no new retainer! Yay!

    So she is supposed to call at 6:00 pm and she called today at 6:40 pm. Her excuse was she doesn't get home until 6:30. DH gives her until 6:30 to call after that he doesn't answer. She has a cellphone! Excuses excuses. Man I don't like her.
