Nanny vacation pay

Hello,

I'm looking for advice re: paying my part-time nanny (2 days/week) for her vacation.  She is taking 2+ weeks off in June.  I knew of her planned vacation when I hired her in February.  So, she will have worked for us ~4 months when her vacation begins and she is expecting to be paid in full for these vacation days.  It seems excessive to me that she would "earn" 2 weeks paid vacation already since only being employed for 4 months.  I agreed to let her have the days off when she was hired but now we are having a disagreement regarding payment.  I have no problem paying her for one week of vacation.  Am I being unreasonable?

  • You didn't discuss vacation or sick days when you hired her? 

    My take- if you like her and want to keep things running smoothly, I'd agree to pay her.  But I'd also discuss future vacation days.  If there was no previous agreement - set up how many days you're willing to give her.  And take these 4 out of her balance.

  • We did discuss vacation and that she would be taking these days.  She would be paid for 2 weeks vacation for the whole year (+ holidays and sick days extra) but as it has only been 4 months, I didn't think she would expect to be paid for this 2 week vacation already.  My friend hired her for an additional day a week and the nanny told my friend that because she's employed her for less than 6 months, she would not expect to be paid for the 2 week vacation.

  • I don't know -- if you discussed that she would have 2 weeks of vacation per year, she told you she was planning to take 2 weeks of vacation, and you said you were okay with her being gone those two weeks but didn't specify that she couldn't use her vacation for those dates because you were going to have the vacation accrue over the course of the year...

    I think I would have interpreted your agreement the way your nanny did.

    If you agreed to pay two weeks vacation and did not specify that she needed to be working for x amount of time before taking the vacation, then you need to pay her. I think it would be very unfair of you not to.

  • I'm not really following.  When you say two weeks paid vacation, do you mean 4 paid days?   I'm not sure what I think about a PT nanny getting paid vacation days, but if anything, I think that 2 days (equal to one working week for her) might be a compromise as you suggest. I don't really think that a 2 day a week job warrants 4 days paid days off so soon after she started. 

    And she's working for your friend 1 day a week and expects to get paid vacation from her too?  That's really absurd in my opinion.  Since when does a one day a week job (or 2 days a week for that matter) warrant benefits?   If one of her days happened to fall on a holiday, I would pay her.  But I certainly wouldn't be paying her for Monday holidays if her schedule was Tuesday/Thursday or whatever.  Not sure how you're working paid holidays.

  • I would normally say that I don't think a 2 day a week nanny necessarily warrants paid vacation time after only 4 months, BUT it sounds like you told her she got two weeks a year (which I am assuming equals 4 days) so you need to pay her.  If you did not specify that she needed to have worked a certain amount of time, then I can understand why she would expect to be paid.  I would just make sure that she understands that she has used her 2 weeks for the next year so if she takes off again before the year anniversary it will be unpaid.

    Honestly, even if you had no specified, I would still probably go ahead and pay her for the 4 days if you like her and want to keep her around.  Trust me, I'm on my third nanny and if you find someone you like, not paying them for a few days is being a little bit penny wise and pound foolish because you may end up losing her...and finding a new, good nanny will consume a lot more time and hassle than that 4 days of pay is worth.

  • Did you do a nanny contract? If not, I suggest doing one soon so next time there is more clarity. As to question, our contract says following:
    nanny works 3035 hrs a week
    nanny gets 2 sick/personal days credited at start of employment
    nanny earns 1 day is sick/personal every 3 months
    paid leave cannot be cashed out at end of employment
    paid leave cannot be credited ahead of being earned

    Just to give you an idea of what we did, it's by no means perfect but it works for us! Hope this helps

  • If she is your part time nanny, she is looking for 4 days off from you and just 4 days of paid time off? In that case if you really like her I would do it, if you want a good nanny to stay with you even part time for a few years you have to treat them right, 4 days compared to the number of other days she will work for you is nothing.

  • If she's good with your kids suck it up and pay her.
  • I would prorate vacation bases on the total number of vacation days she will get each year and the number of months she has worked for you so far.
