Texas Adoption

I have a friend who is working with a EP in Texas and while they wait to get in touch with a Texas attorney, I was wondering if any of you have experience with adoption there?  The BF is in jail so that might complicate the adoption.  The question is, can the BF sign any time or does he have to wait until after the birth?  Most often, the BF can sign any time, but from some Google searches, it looks like that might not be the case in TX.

3 Femara cycles - Oct, Nov, Dec 2011, all BFNs 
IVF #1, ER 2/15 (5R, 4M, 4F), ET 2/18, Beta 2/29 = BFN :( 
Follistim + IUI on 6/25 = BFN 
Home Study Finalized 8/14/12! Profile Active - 8/17/12!

    For BF in Texas consent can be anytime before or after the child is born.

    Thanks..my friend actually heard back from the attorney and the BF can't sign until 48 hours after the birth.  I am not sure why your info is different..maybe because they are married..?
