Reporting a Probation Violation?

If BD is behind in child support, would you report it to their parole officer?  Or would you be patient and wait it out?  Bitchy or fair? [A condition of release is support of dependents and to work regularly at a lawful occupation.]

How far behind? Has he been in contact with you in regards to plans to pay?

  • How far behind is he? Does he ever pay? How often does he see his child? Does he provide good care to the child? Do you need the money?

He is a couple of months behind, hasn't had any contact with DD in over 3 months, and before that it was probably another 3 months.  He provides no care.  CS would definitely help but situation is not dire.

  • What's he on probation for? That would factor into it for me even though it shouldn't.

Then yep, I probably would report him. Or maybe let him know that if he can't get current on payments in 60 days you'll be reporting him?

    Federal drug trafficking.

For me it would depend on his employment circumstances.  It can be difficult for someone with a felony to find a job.  Is he seeking employment?  Having a hard time finding a job?  If yes, then I wouldn't report him.

If he wasn't looking, or had a job under the table and wasn't paying you, then I would probably report him.  Or at least report it to any agency that could collect directly from his paycheck (in the hopes that it would be reported to his parole officer).

Also, for someone convicted of drug trafficing....I would probably hope they would forget about ME / DC, so I would lay low and not speak out in hopes that they would continue to not visit DC.

    These are valid points.

Before this my advice was of he is not seeing your child then it does not directly hurt her if he gets in trouble. But I might ask first when you will get it. But do you think I he goes back to jail it could threaten you or your child? You could be calling his parole officer and putting him straight back in prison.

I say contact the agency that he is supposed to pay CS through. If they report him then fine, if not then it will catch up to him eventually. My first thought was to report his butt since he wasn't paying CS and wasn't even trying to be present in your LO's life. But Wahoo had a good point, maybe laying low and hoping he forgets about you guys is best.

I did this - I contacted the agency and provided all the information. Thanks for all the advice. I know when I get fired up, it isn't always easy to see the best solution.
  • Wouldn't reporting a probation violation put him back in jail?  And what would that be for a federal drug trafficking charge?  So the point of reporting him would be what exactly?

If it's about child support, then reporting him is pointless.  Because you obviously won't get any money from him while he's in jail.

If it's to put a worthless peace of crap back in jail because you don't want him in your child's life...then that's an entirely different thing.
