BM has brought up that she wants DH to get a life insurance policy with her and SS as the beneficiary incase something happens to him of 1 million. He is currently paying child support, and is not behind no has he ever been behind. DH has told her that SS will be taken care of, but I will be the one to administer any money to SS and it will not be giving directly to her, but to pay SS's bills. I do know she is able to get a portion of his social security (so am I and DS), but I am just wondering if she can claim any of our joint assets (house, vehicles). We have wills giving everything to eachother in the event of death, but with DH's job so dangerous, I just worry about having to fight BM for our house and assets, and having to sell everything just to pay her what she wants.
Re: Estate question
I dont believe she would be able to claim any of the estate herself, but for this reason, we set up a trust for SS. If DH and I were to die together.SS would get everything. Since he was a minor we set up that DH's sister was the trustee.&n
As long as your husband has a will she can not make a claim on the estate.
if he has no will it gets murkier, as his wife you are next of kin and if there is no preexisting will (even an old one that leaves everything to EW would overi

HOWEVER, DO NOT TELL HER ANYTHING. All your DH needs to do is tell her that he has taken ca
DH's CO specifically states that he is required to maintain a life insurance policy to cover his child support obligation for as long as he has the obligation. This is fairly standard around here and any lawyer worth their salt would ask for this
