Estate question

BM has brought up that she wants DH to get a life insurance policy with her and SS as the beneficiary incase something happens to him of 1 million. He is currently paying child support, and is not behind no has he ever been behind. DH has told her that SS will be taken care of, but I will be the one to administer any money to SS and it will not be giving directly to her, but to pay SS's bills. I do know she is able to get a portion of his social security (so am I and DS), but I am just wondering if she can claim any of our joint assets (house, vehicles). We have wills giving everything to eachother in the event of death, but with DH's job so dangerous, I just worry about having to fight BM for our house and assets, and having to sell everything just to pay her what she wants.

Re: Estate question

  • I dont believe she would be able to claim any of the estate herself, but for this reason, we set up a trust for SS.  If DH and I were to die together.SS would get everything.  Since he was a minor we set up that DH's sister was the trustee.&n

  • We do have it set up so my parents are trusts for both boys if something happens to both DH and I, but she is concerned that she will have to get a job if something happens to DH and wants to make sure that she gets atleast a million. Its not that BM does
  • Unless court ordered, you have no obligation to get a life insurance policy for SS and especially for BM. DH and I have one for that amount and it costs over 200 per month, with each of us as beneficiaries. Also, depending on the type of account you may a

  • It's pretty damn presumptuous to ask for a life insurance policy of $1million. Holy crap.

It's my CO that XH and I each maintain a life insurance policy of at least $100k payable to each other.
