Help Please....Is my boss getting one over me????

 So I need some help. This was discussed with me by my boss today and it just doesnt feel Kosher. Any help would be greatly appreciated, especuailly by any lawyer Mama's out there....

So I plan on taking 1 week vacation + 4 weeks paid maternity leave. All covered as per normal. Normal amount being contributed by boss, remaining being taken from my weekly check as per normal.

I will be returning to work thereafter for 6 weeks part time (20 hours a week). During this time I would switch to COBA and pay 100% of all medical insurance- no contributions by the Boss. (He said its because he doesnt offer part timers insurance.)

I will then be taking the Summer off 7 weeks unpaid + 1 vacation week at the end. Also During this time I would take over 100% of the COBRA payments without any contribution from my Boss.

Than returning to work full time (47 hours a week). COBRA would still be in effect but my boss would resume his normal contribution towards insurance and I would pay the difference. This would continue for 12 weeks apparently so figure December 1st I'm back to normal.  

This just doesnt sound right - no FMLA at all??? ... any Thoughts????

  • How big is your company? Companies with less than 50 employees do not qualify for FMLA.

     FMLA only comes into play if the organization has over 50 employees - and it isn't paid leave so I'm not sure how insurance figures into it.

    I am responsible for my portion of the health insurance while I am on leave.  So say my portion is $200 eve

  • I work for a huge hospital. Even on FMLA you are required to pay for your insurance once your PDO is gone. PDO must all be used up at the start of FMLA.

  • FMLA has nothing to do with your insurance coverage. I am taking FMLA and will be responsible for my insurance while I am out for those 3 months (coming to about 200 every 2 weeks). I will only be going back part time so I am choosing to change insurance
