Yes I am ranting

Here we are again behind several months on child support. I asked for a re evaluation back in June of 2012 for child support.  I called the state a couple of weeks ago only to find out that in the past eight months they had done nothing.  The cases submitted are suppose to have activity within 180 days here we are 8 months later and nothing....Now that I called something has to be done within 20 working days.  WOW I want stuff to sit on my desk for 10 months and not do anything with it.  I am sick of my kids seeing all the crap from facebook that his wife posts yet they can't pay child support in a timely manner.  In the past 5 months they have taken a week long cruise, a week long trip to New Mexico, a four day trip to Las Vegas, bought a 20K Harley and this weekend a 15K toy box to haul the Harley in, but can't be bothered with the 3 months in child support that is owed and another measly $50 for Dr copays.  Yes I am bitter and pissed that the kids come last and they see the child support as money for me.  I work, my husband works and my kids do not want for anything.  It is principal at this point!!  Flame away if you must or tell me I am a catty witch but the system is broke for sure.

  • It's a valid rant! C/S should be paid first. If life changes and you need a revaluation then get it the right way. You don't just not pay. Every parent has a financial responsiblity to their children. I'm sorry they are not taking your case seriously.

    A SM whos H constantly gets crap for BMs "doing it all financially" regardless of c/s never being late, carrying insurance, spliting all extras, medical bills, and back to school shopping.

  • No flaming from me, I agree with you.  My XH is supposed to be on parole and seems to have been able to quit his job.  I haven't gotten child support since October, and he is about 2 months from being over $10,000 in arrears in total.  I think he only paid child support for just over a year before he decided he didn't want to anymore.  I'm sure that the arrears are less than many out there, but it is irritating that I am the one providing everything for two pre-teen/teenage boys and he is allowed to sit back and laugh.

  • I know that three months is nothing compared to a lot of people and I wish I could somehow change the system so that every parent in the situation did not have to put up with this crap.

  • Completely agree!  The Friend of the Court system is a joke! 

    Our judge signed off and ordered child support April 2012 - still haven't received a penny!  Apparently FOC did not send a request for C/S to ex's place of employment and no matter how many telephone calls I have made to FOC - I get no response.  Attorney's seem to be no better - fired the first one as he couldn't seem to get it going either.  Went with a much larger firm for the new att and still can't seem to get anything done.

    What world do these people live in that makes it ok for issues to not be resolved in months or years?!

    Hope that you are able to get this resolved!  Unfortunately from what I've seen it won't be quickly!

  • Do you live on TN? That sure does sound familiar! In TN anything regarding CS or gov assistance has a certain amount of days to be done. Guess what happens if they don't donit.in that time frame regardless.of whether or not you turned all your stuff in two months ago... CASE CLOSED! Yep, that's right. And you have to start all over again.

    Btw, that is if CS goes through the state system. If your lawyer is handling it, then it can get pushed back indefinitely time and time again.

  • I am in Texas as at least they have not closed it....I would really be pissed then.  I don't have an attorney so that can't be the reason it is delayed.  I get that things take time but I mean jeez all they have to do is request proof of income from him by sending a letter and then go from there and not even that has been done.
  • BM has done the Facebook screen shots to us as well, but in Iowa they do not stand up. we pay each month on time and have never been behind but she still feels she deserves more because we both work full time. SS never wants for anything with us, if he needs it we buy it. I feel your pain. Children should be number one regular less of which house they are in

    I am in Texas as well and the system is a joke. My BF did not start having his wages garnished until this past Friday.  We have been playing the CS game for eight years and he has had his wages garnished for only two of them.  Never with his current job, even though he is an actual employee and pays taxes through them.  I think that the only reason they got on the ball is because he bounced a CS check to the Attorney General.  I thought the system flagged those who owe CS, but I apparently not.  When I have issues I email the system through the website.  I tend to get more of a knowledgeable response than if I call.  You should try that and ask why nothing has happened.  Plus it starts a paper trail.  Good luck.  I know you must be frustrated.

    Your income should never be a factor and BM is wrong for even being suggestive of that.  That is like my son's father saying he shouldn't have to pay CS because obviously me and SO are doing a fine job financially supporting him.  She is lucky though to have someone that is supportive of her son and puts her son first.

    I will say that I handle our finances and child support is the first "expense" that is paid.

    I used the website yesterday hopefully that will help, I  don not understand becasue my DH had a knee surgery last summer on workman's comp and was out for 2 weeks and they didn't take the child support out of the workman's comp checks.  The AG started sending a notice once he missed one week and when we realized it wasn't taken out when the check came we sent it on ourselves so the letter and the check crossed in the mail.

  • I figure the facebook posts can't hurt as he is in the pictures and his name is referenced.  She tries to say she makes all the money that pays for all these things and that is fine but I am sure it is not true.  I just want the CS paid on time and the amount to be fair.

     Just keep trying.  I know that every three years the amount can be reviewed.  Also, if there is a change in circumstance or his tax return shows he makes more you can apply for it to be in review.  Standard in Texas decrees is a clause that says they must show you their tax return for the previous year by April 15.  If there is a huge discrepancy in the amount child support is determined on and the amount he is making you can try to apply for it to be reviewed.  Definitely keep pushing for CS to be established, but maybe wait to apply for a review until April 15th.
