In-family adoption

Does anyone have any experience adopting a family member? Our lawyer seems to be dragging his feet and charging it up in the process. We have had our DD since she was 5 months old and now she is almost 3 years old. One of the birth parents has voluntarily signed over rights but the other has not. We had permanent custody awarded I believe in April of 2012 (please forgive me we were in and out of court so much it's hard to keep track anymore) and have had this adoption lawyer hired since right after. Drugs and rehab are involved with the birth parents so that kind of complicates things. I'm getting impatient. DD doesn't even know her last name because we want to make it legal and she will be starting K3 this next school year. Just getting impatient!

    I know, he is probably just trying to make sure we approach it a certain way. But then we blow through a retainer and have a hefty bill after, and nothing to show for it :( My brother is the one who signed over his rights, but the birth mother has not... But she has not seen or tried to contact DD in a year now, and before that she only saw her three times in 3 months and it was a year before that with no contact on her part. The lawyer said we need 4 months of no contact for abandonment....I'd say we got that! But he is worried about whether she voluntarily went to rehab or whether she was court ordered, because he says it will make a difference in court.

    My parents adopted my nephew about 2.5 years ago. I remember it taking a while (over a year) and lots of hurdles to jump through. I would find a new lawyer....or before doing that question what's taking so long and stay on their tail. My mom had to "bug" her lawyer to get stuff done! GL!

    He is supposively the best in the area, so I will probably stick with him, but will turn up the heat and bug him :) Thanks!
