I am a NJ resident, but I now work in PA. I'm getting conflicting information from my company as to which state I would be covered under, so I'm trying to get information about both. I have NJ, but PA is pretty hard to track down. What are the leave laws in PA for maternity? In NJ, just with STD, I can take up to 4 weeks prior to the birth and 6 weeks after for a vaginal birth and 8 weeks for a C-Section. I have heard that PA does allow up to 6 weeks after for the vaginal birth, but nothing before the baby is born. My location is very small, so I don't technically qualify for FMLA.
Any help or guidance would be greatly appreciated!!
Re: PA Maternity Leave
FMLA & STD are two different things. Since you work in PA, you'll be under our benefits. FMLA will allow for up to 12 weeks unpaid. STD (depending on your employer) will allow for 6-10 weeks, IF they have STD benefits.
my PA employer will allow me to overlap my STD while on FMLA, so i'll get a portion of my regular pay and be unpaid for the last two weeks (if i decide to take the full 12 weeks off)
