PA Maternity Leave

I am a NJ resident, but I now work in PA.  I'm getting conflicting information from my company as to which state I would be covered under, so I'm trying to get information about both.  I have NJ, but PA is pretty hard to track down.  What are the leave laws in PA for maternity?  In NJ, just with STD, I can take up to 4 weeks prior to the birth and 6 weeks after for a vaginal birth and 8 weeks for a C-Section.  I have heard that PA does allow up to 6 weeks after for the vaginal birth, but nothing before the baby is born.  My location is very small, so I don't technically qualify for FMLA.

Any help or guidance would be greatly appreciated!!

Re: PA Maternity Leave

  • Hi! From what I understand, PA does not offer paid maternity benefits at all, but lucky for you, if you work in NJ, you get the NJ state benefits! Not sure why they are giving you a hard time though. So in NJ, you can get 4 weeks prior to delivery (with a doctors approval), 6 weeks for reg delivery or 8 for c-section, then another 6 weeks for family bonding all at I  think 60% pay. PA gives nothing.

  • Check with your employer.  From what I understand in PA, there is no state regulation, but different employers/insurances do different things.  Mine allows for leave prior to birth if medically necessary.  If your employer has 50 or more employees, FMLA mandates that you can have 12 weeks, but they don't have to pay you for any of it.

  • I've heard from multiple people 6 weeks paid for vaginal, 8 weeks for c section but I'm not sure if it's state mandated or just common practice. Good luck!
  • FMLA & STD are two different things. Since you work in PA, you'll be under our benefits. FMLA will allow for up to 12 weeks unpaid. STD (depending on your employer) will allow for 6-10 weeks, IF they have STD benefits.

my PA employer will allow me to overlap my STD while on FMLA, so i'll get a portion of my regular pay and be unpaid for the last two weeks (if i decide to take the full 12 weeks off)

  • If you work in PA and your employer is too small to qualify for FMLA I don't think they are required to hold your job. Your Dr will put you on medical leave for 6 weeks post birth but unless you have STD it won't be paid unless your employer gives you paid leave.
