BM's last name?

I posted a week or so ago about our lawyer helping us modify CS. We need to have her served with papers but we aren't sure what her last name is. She wont tell us and refuses to answer when DH asked.

When DH and BM divorced she kept DH's last name, M. She has a live in boyfriend, last name Y. After DH and I got married she said her and BF were engaged. They set a wedding date but it got pushed back multiple times. One day she implied they were married and that she hadn't gotten around to changing her name yet. This was 2 or 3 years ago. SK's said they don't think BM is married. BM's family doesn't know.

Both BM's FB and twitter have her last name as Y. I'm guessing that she isn't married but it's possible they went to the JOP  without SK's and never mentioned it.

Is there anyway to find this info easily and preferably for free? I've seen sites that have this info but I'd have to pay for them. I didn't know if there is an easier way.

  • I don't know about your area but in my state marriage records are public. You could easily go to the county clerk recorder and search for marriage licenses by name. It won't tell you if she changed her name if she is married but if she isn't married then you'll know she didn't.

    Would I have to go to the county where BM lives? We live in the same state but BM is in a different county two hours away from us.

  • When we served BM with papers we sent it to her maiden name. Our BM has her married name, but she and her H are not together for the time being. She has her name as her maiden on fb, and she will always have some connection to her maiden name. It worked for our lawyer and court because we have no clue what her name is on her dl.

  • You can call the court house in her county, usually they will give you that info since it is public record. Also, I don't know your situation but if SKs are in school, you could probably find out from the school since its for legal purposes. GL!

    Just an FYI but people on here have had SKs registered with a last name that is not their own, don't know how people do it but apparently people will lie a gout anything on anything.

  • Last name dosen't matter I had hyphenated name married to ex but even when I served him recently with my new married name most of paperwork has old name because that was name used in divorce

     

  • When we had BM served they wrote it Firstname [Maidenname] Marriedname.  The papers were valid even though BM never had her name changed legally when she got married.

    I'd just send them to her maiden name if I were you.

  • Thanks ladies. DH has to go by our lawyer today to drop off some papers. I hope we have the same experience most of you had where it didn't matter.

  • for whatever reason, whenever we go to court, everything that has BM's name on it is DH's last name. She never even changed it legally to his name. I don't think it matters.
