Maternity Leave...can someone help me understand....long

Ok so my HQ is based in Utah, when I spoke to HR they were not familiar with all the NJ maternity leave options we have here. AND I am so confused myself can someone help me under stand the breakdown so when I speak to HR again (when I get closer) I have everything straight.

OK so here are all of the options I have for time off:

NJ Short Term Disability- 4wks prior to due date and 6wks after birth

Company Maternity leave- 6wks total (but I only get 2.5 weeks paid in the form of sick pay 1/2 rate)

NJFMLA- 6wks paid (6 wks not paid ....may not take)

28 weeks total time off 18.5 of them paid....is this right?? Do I have to take them in and special order?

I do not quailify for the federal FMLA because HQ is in another state and I do not have 50 co/workers in a 75mile radius of me.

  • You can take all of the time, for NJ FMLA you are aloud to take that time anytime with 12 months of giving birth....so lets say I had the baby came back to work after 6wks then worked for 3weeks I would be aloud to take 12wks leave after that for bonding through the NJ FMLA.

     

    I just wanted to make sure the order I take everything in is correct, I know I would have to take the NJ STD first but not sure if I should take the NJFMLA after or my company materinity leave

  • If you decide to take the up to 4 weeks prior and 6 weeks for vaginal and 8 weeks for C-Section. .  

    you would take the 4 weeks prior in NJ Short term Disability.  Then you would need to claim on the 6 weeks after that you get paid for your Company Maternity leave, because you do not collect both, unless you are below the cap and NJ does make up the different.  then the 6 weeks of NJFMLI kicks in after the 6/8 weeks of your other maternity leave expires.  Does this make sense.

    I would also check with your organization that they do not make you use all your sick and vacation time, before you can claim maternity leave.   

    Additionally, I believe that the NJFMLA runs concurrently with FMLA, but I am not sure on this last statement. 

  • NJ Disability and your company maternity leave are taken concurrently. This is a "courtesy" pretty much provided by your company. It is not required for any company to offer maternity leave. So, it is not 10 weeks plus 6 weeks plus 12 weeks. You can take NJFMLA after your NJ Dis and company maternity leave are complete, but there are several stipulations for taking FMLA.     Most importantly, the location where you work must have at least 50 employees. The total number of employees in the company does not matter, your particular location has to have 50 employees.
