Hello Ladies, I know this question has prob come up before but I just wanted to explain my issue and see if I have everything straight or am I missing something HR seems to be a little sketchy with time off.
So I contacted HR to find you what the ML policy was the person told me that our company gives you 6wks leave and if I wanted more time I would have to get permission from my Mgr. (our HQ is based in Utah) and the ML pays at their sicktime rate (of which I never really understood, DH thinks its illegal)... see below
Sick pay is as follows: one year of service ? up to two weeks at ? pay, three years of service ? up to four weeks at ? pay, five or more years of service ? up to six weeks at ? pay.
So I have only been with the company for a over a year by the time I would deliver it would be 2yrs. I do not quailfy for FMLA because I work in one of there sales offices so less then 50 employees in the office. So I was going to save all of my vacation time and personal days up till that point assuming I would have to wait until the very very end. OK so here is my break down do I have everything straight.
Company ML 6wks (4wks paid) followed by 12weeks(6wks paid) of NJ Paid Family Leave for a total of 18 weeks leave roughly 4months...am I missing anything does anyone know of any other way besides FMLA I can get paid time off?? I was a little bummed I didnt realize I didnt quailify for FLMA I was looking forward to spending almost 6 months home with my baby oh well I should not complain with 4m I guess.

I am an HR professional in NJ. When it comes to leave requirements, in NJ there are 2 laws that provide for job protection only, Family Medical Leave which is a federal law and NJ Family Leave which is a state law. To qualify for leave under FMLA you must work for a company with 50 or more employees, work in a location with 50 or more employees within a 75 mile readius, have worked for the company for at least 1 year and 1250. To qualify for leave under NJ Family Leave Act you must work for a company with 50 or more employees nationwide, work for the company at least 12 months and 1000 hours. Based on the information above, you do not qualify for leave under FMLA but you do so under NJ Family Leave Act. Any leave provided by the company can run concurrently with NJ FLA, so the max leave you may be entitled to is 12 weeks based on company policy. If they do not require the leave to run concurrenlty, your max leave is 18 weeks.
As a NJ employee there are 2 insurances that provide for insurance protection, NJ Short Term Disability which covers 2/3 of your salary up to $587 (give or take a buck or 2) a week and NJ Family Leave isnruance which also coevrs 2/3 or your salary up to $587 a week. STD will cover your recovery from your delivery and any other time your doc says that your disabled as a result of the pregancy. For a vaginal delivery you will typically be eligible for 6 weeks of disability insurance. Your company probably considers the NJSTD payment and that is why they do not pay full salary for a sick leave. NJ Family Leave Insurance is paid once you have been cleared by your doctor and is designed to protect your income while you are on leave caring for a family member or bonding with baby. You can only collect NJ Family Leave insurance for up to 6 weeks. Eligibilty for these 2 insurance plans does not extend your leave. Receipt of the payments runs concurrenlty with your LOA.
Please note that your company is not required to provide any payments while you are on a sick leave and can choose to offer only partial payment while on leave. In fact, it is generous of your company to do so.
