Question about child support

I've posted here in the past, and really appreciate the advice here... I have been away (had a baby in August, been super busy ever since) so i doubt any of you remember my original post... but here is a short summary: BF has not paid child support in nearly 3 years now, and was really flakey about his visitations. We did have 50/50 custody, but due to many, many problems and much instability on his part, I filed for full custody. A lot of issues on his end followed, including him moving 5 hours away and demanding I send my daughter to visit, which I never did, and him moving from house to house to house. Thank you all again for guiding me through that sticky situation.

 Here is the updated part:

We went to court in September, and I won full custody, with him having to pay 6500 in back child support, and he will get EOWE visitations at his sisters home (because where he is currently staying is unsuitable) after he completes 4 consecutive weeks of 2 hour visits. The visits are a whole other story! The judge ordered him to begin paying $60 a week, beginning September 18th, and when he finds work (because he hadn?t worked in years) the appropriate support will be garnished from his checks. He has been working about 3 weeks now, and I have yet to see a penny. With Christmas coming up, and after the lawyer fees, I really need this money. What do I do from here?

  • Don't count on seeing anything in time for Christmas.  Even when family court is effective, it is almost always slow.

    Contact the child support agency in your area, and they should be able to guide you.  You'll probably have to file contempt charges.

    You said he's been working for three weeks. If he started in the middle or at the end of a pay period, he may have not even gotten his first paycheck yet. But I would urge you to not put yourself in a position where you rely on getting the money.

    I called the offices, and I got a general direction of what to do.

     

    Each time I ask him when will he start submitting to the address (before he was employed) he kept saying he didnt have it. Even though he had the copy of the court order, etc. I texted it to him numerous times, he just chooses not to pay. But I am going directly to his employer today, I know his company well enough to know he gets paid every week. 

     

    I wont get myself in the situation where I depend on it... Its just that right now I do need it pretty badly. My savings ran dry with the lawyer fees. :(  

    How do I go about contempt charges, if that is what I decide to do? Can I do it without my lawyer? 

     

  • If the CO was for wages to be garnished, you need to be contacting the agency that deals with your CS not his employer. You should be able to contact the agency and give them any employment info and let them handle it, that is what they are there for. It usually takes weeks for the CS agencies to remit info to a new employer and then it may take 1-2 payperiods for the employer to begin garnishing. If you contact the agency yourself to inform them of the employer you can usually get the ball rolling faster. These things are never instant.

  • Yeah these things don't move quickly. DH got a new job 3 weeks ago and has been paid twice (weekly pay). C/S still isn't coming out. He told his manager and payroll upon getting hired and called the c/s office to give them the updated info. Even with him directly involved the garnishment hasn't started yet. So for the second week in a row I will mail in a money order to keep the payments up to date.

    I guess my point is even with full and active participation from the NCP it is still slow.
