Medical Expenses?

XH and I have finalized the divorce, and we have agreed to pay for half of all medical expenses. However, his idea of medical care and mine are vastly different. I am on the side of being proactive and preventive, whereas he would rather not go to the doctor unless or until it's an emergency. He has never taken either child to a routine exam, it has always been me.

Last week he decided to take DD to the ER because of a breathing issue she was having. I was out of town and only found out about it after returning because my 4 yr old daughter told me. (Can you say furious?)

Short story long, she has allergies which in turn cause some breathing issues. I am able to keep it well controlled at my home and she rarely has to use the nebulizer. I don't know what he's doing, but he doesn't seem to have it controlled at all because she frequently needs to use it at his house.

Fast forward to today. I took her to a neuropathic doctor who recommends some nutritional changes. Not a big deal.

The issue I have is that XH is refusing to pay his half of the expense. Anyone have advice on how to handle this? I have recently had to let my attorney go because I can't afford to pay her.

  • I had in my papers that XH has to provide the insurance (so it's under his name) and anything that it doesn't cover we pay half, therefore, I would pay him. So I don't have to worry about that. BUT I would def. take him to court over it, if it's a large amount.

  • In my state, I pay for the medical expenses and then I submit the reciepts over a designated amount to CS enforcement and they add it to his arrears balance for CS.

    I keep insurance on the kids and since trying to get regular CS out of him is difficult I haven't ever submitted the medical receipts.  But that's the procedure.  See if you have a similar procedure in your case.
