Gosh, I feel like such a newb between this question and yesterdays question!
My company's policy on FMLA is that it runs calendar year instead of every 12 months, meaning I only have to wait until January to get another 12 weeks and not a full 12 months. So how does that work? Say the doctor puts me on bedrest for the rest of the pregnancy and I have the baby in early January, does that mean they have to hold my job for 6 months? Or do I have to come back for a period of time before the 2013 "12 week coverage" kicks in?
Does this question make sense? I'm asking because I'm having a ton of contractions. At my 19 week anatomy scan my cervix was at a 5, then a week later via a transvaginal u/s it was at a 4.6, and now it's at a 4 (another transvag u/s). He told me to take it easy (obviously he does not have a 2.5 y/o boy!) and to stay hydrated, etc but if the contractions continue and it goes to a 3.5 or lower he's pulling me from work and putting me on bedrest.

I don't know - I think I'd have to ask because their policy is different. With mine, I can take 12 weeks in a year, starting with the first day I took leave.
So if I had a baby April 1, 2012 and started leave that day, I have until March 31, 2013 to take all 12 weeks of leave. If I started my leave before the baby was born (say March 1st, 2012), then I'd still have 1 calendar year (until February 28th) to use all 12 weeks - if I wanted to.

Wanting to hold off on that conversation with HR bc my boss just left and they are doing some major restructuring within our dept. I want them to redefine my role before they think I might be out for a while or what not. I know, i know that is a rediculous reason. I guess I will see where I stand next week with the dr before I ask HR about it.
I work in HR- I would think that your 2012 FMLA time expires 12/31/2012, so if you take the last few weeks in December off then you only used a few weeks of your 2012 alotment, the remaining time doesn't rollover to the next calendar year. 1/1/2013 starts completely over and you would have a fresh 12 weeks to use for all of 2013.
While on your FMLA leave you have job protection, however some companies find loopholes...like elimination of positions (a college told me this happened to her).
Still check with your company policy and HR, but this is my thought process I hope it makes sense!

I wouldn't think so- maybe your doctor may need to provide further documentation that you are still not medically able to get back to work. I re-read your post and now see your point- sorry!
