NBR: speeding ticket troubles....worried about warrant?

Ok so I live in SC area and every friday I drive to Atlanta area for work. On 7/26 I exited the HWY onto my exit and  was immediately pulled over by a *crazy* motorcycle cop who literally ran out in front of my car in the exit ramp.  He clocked me at 74 in a 55! yikes but come on, I had just crossed six lanes from left to right and EXITED it takes a minute to slow it back down on the ramp! Anyway, I got a ticket. He told me my court date was sometime in October.

Fast forward to now, I have remembered about the ticket but since I was not planning to go to court, I figured I would pay it in September. I started looking for the citation and realized I changed purses and threw away the old one I believe it was in there (baby brain!!!).  So I called the county, the courthouse, the city, the state patrol, EVERYONE and no one has me in their system as getting a ticket. Fabulous, right? Maybe not. I am terrified now I will get pulled over after the court hearing and there will be a warrant out for me and they wont believe that I tried to pay the ticket.

Any advise? I dont need to be in jail 8/9 months pregnant!!! Do you think I could get something in writing from each of these places that I keep in the car? I doubt they would play along with me but still...this is scaring me a bit.

  • Do they have an online site where you can check criminal records?  In Wisconsin if you type in Wisconsin Circuit Court.  In Illinois Chicago has their own but the state is different.   I would try something like that.   You plug in your name, DOB and it pulls up any citations and convictions that you have.

    If that doesn't work I would go down to the court house before October and ask them to help you in person.  In person always gets more results than over the phone.

    States are broke, trust me, they'll find your ticket.  :)

  • I did try online with my name and DL number, No dice. I just tried to call again and a very friendly lady looked by my TAG number, no dice. This is insane. I do like the idea of going there in person, its not convenient as I will need to drive 2 hours BUT being arrested is pretty inconvenient too! lol.
  • I work for a State Patrol (not in your state) and its possible you have a Trooper sititng on a ticket (which they can get in big trouble for).  If it was me, I would physically go to the post in the county which the ticket was given and speak with the Lieutenant.  WIth knowing the date/time and location of where it occured, he would be able to look at past schedules and line assisgnments and know which Trooper it was and track him down for the ticket.  Its also possible he will waive the ticket when its found due to the Trooper's error in not turning it in in a timely manner.  The reason I would do this is because I would fear that if you didn't you're at the mercy of when the Trooper decides to clean out his car and find it and turn it in or not, etc. 

    For what its worth- I'm sure the Trooper's opinion regarding the ticket was knowing your exit was coming up you should have been prepared to exit well in advance so you weren't speeding and crossing six lanes at one time.

    I'm a Trooper in a different state, too, and this would be my suggestion as well. If we don't turn in tickets in a timely manner, we are liable. And by timely, we have 5 business days.

  • Great suggestions! Thank you all so much. I was able to get an email sent back to me from the local recorder's court that confirmed no such ticket has been turned in as of yet. That does make me feel better about driving should I get all the way to October without them being able to find the ticket. I will definetly go see the State Patrol as you suggested.
  • Probably a silly thought, but have you checked with the city, county and the state police departments? Near us, all 3 jurisdictions give tickets...

  • Is it possible that your ticket was a "promise to comply"?  Those are generally not kept on the record.

    Have you checked the administrative office of the courts? In NC you can search your name and see your charge and date, etc.

     Make sure you keep a record of EVERYONE you talk to - what time, department etc. so if your court date passes and a failure to appear is issued, you're covered.

    I recieved a ticket that was marked "promise to comply" and issued a court date.  The way it was explained to me was I either could show up to court to fight it, or lose points.  When I didn't go to court (I had been visiting my sister who lives 18 hours away) I recieved a letter letting me know I lost 1 point.  This happened in IL and was for speeding-I was driving 65mph in a 50mph zone.

  • See, this is all so confusing when it comes to different states and adding/losing points.

    I guess a promise to comply for you is like a waived ticket for us - you can pay it by the court date and this pleads you guilty or you can show up on the court date and see if you can get it reduced or plead not guilty and go to trial. 

     I wish all states were exactly the same when it came to points and how the court system worked. It would make life so much easier for out of town drivers who get in wrecks or get stopped for whatever reason.
