Personally I think the mother should get the ticket. Sure I have never potty trained but I imagine when I do I will still carry extra clothing for when my kids are still having accidents. Also I am pretty sure I would have made sure the little boy would have at least tried to go to the bathroom before we left the restaurant before going shopping. I cannot think of many clothing store (I dont mean places like Target or Khol's) but boutique type shops to have restrooms for customers to use.

No way. She shouldn't get the ticket. As PP stated, when a 2 year old (this is a whole year younger than when we potty trained DS!) says its go-time, there is no waiting to find a bathroom if it's not accessible quickly. DS has peed in the bushes at the park 2x in his life (not a habit by any means) b/c there was no alternative despite the fact that he was asked or did in fact use the bathroom 15 minutes before at home.
From the article, I know the area where this woman and her family were walking and it's not the most kid-friendly space despite being a busy shopping/dining area. It is not a mall type area with big stores with plentiful potty space.
The cops need to give this mom a break; there are far worse things...
My cousin's 2 boys...would go when they had too and they didnt care when or where they pee'd during potty training. I've been in public places with her more then once when her kids just took it out and pee'd (always outdoors)....they dont know any better...she and I just tried to block them off so no one else saw.
Now my cousin never encouraged that behavior....it just happend. And her kids absolutly did it spontaniously...afterward they got lectures on waiting for a bathroom or letting her know they had to go but when your teaching a child not to pee their pants and they have that concept down....telling them to pee themselves so you can change them will only mortify the child and completly undo potty training as it is.
It certainly isn't the best case scenario but it happens. Personally I say kudos to her....potty training was a success and her kid didn't want to pee himself. I wish things were going that great with DS1!
I am not saying in any way I would tell my child to pee themselves. Yes that would be a horrible thing to do but at the same time I don't think having a child pee in the street would be acceptable. Sure I have never needed to potty train yet but I would think accidents can and do happen and its our job as parents to help them if they do have an accident without shaming them or making them walk around in wet clothing.
But I think that what we're saying is, what other choice did she have in this case? If there was not a public bathroom nearby, what else could she do? Her choice in that moment seemed to be to let him pee in public, or have him pee his pants and deal with the child being upset and possibly regressing in his potty training.
FWIW, I've let my son pee on the side of the road of the turnpike before. we take lots of road trips to visit my IL's and sometimes those rest stops are spaced very far apart. Could a cop potentially give us a ticket for that? I'm sure he could. Would I be outraged if that were to happen? Absolutely!! My son is 4.5 and has been potty trained for awhile now, but it's just not reasonable to ask him to hold it for 30+ miles.

I have a few comments here:
1) If you are potty training bring an extra pair of clothes (mistake #1)
2) Told him "go over there and pee"- that gave him permission, he didn't just walk over somewhere and pee (mistake #2)
3) She was with a group of people, pick up your toddler and RUN to the damn diner! Everyone else who can hold it can wait and walk with the elderly grandparents. (mistake #3)
4) As a mom who has potty trained 3 children (working on #4) your child can hold it longer than you think. Yes, they will FREAK OUT and say "I have to GOOOOOO" but truth be told I have made it (more often than not) 1/2 through the mall, to make it to the food court which has the only bathrooms, with small children with a child telling me they are going to pee the entire way there.
Does is suck she got a ticket, yes, but she let her son pull down his pants and pee in a public place. She took a risk and it didn't pay off.
*Note- I HAVE let my boys pee in the bushes (way out of sight) a hand full of times when there were no bathrooms anywhere around, but if I got busted for public urination I sure as he!! wouldn't be making a public stink about it. (it's also the reason I carry a travel potty in my car)
To the poster that said "he would be mortified if he peed on himself" how do you think he will feel now that his picture has been posted all over the internet for getting a ticket for public urination- that embarrassment will last a lifetime.
