We don't have a set visitation schedule, we were doing ok with coming to an agreement and sticking to it.

Does this mean that you do not have a legally binding Court Order (CO) or that your CO does not address the exchanges clearly enough?

Either way, instead of going round and round with each other, contact your lawyer and try to get something written up legally now.  Oh and make it EQUITABLE and add specifics on times, places and what happens if one parent cannot follow through with his/her responsibilty.

  • I'm completely with you on this. This sounds fairly similar to the situation I was in earlier this year (BD "moved" nearly 4 hours away to live with his GF and their DD at GF's parents' house. He too wanted four days per month vs. EOWE.) Although, in our situation, I refused to do any of the driving, per my attorney. Our CO forbids us from moving that far, and I was not going to waste almost 8 hours of time because he was making a poor decision. It was completely unreasonable for BD to expect you to even do any driving, and kudos to you for being willing to do so. BD made a decision to move away from DS. That is not your fault. And, you said BD end up finding a car to use. So, there you go. He was just being lazy and trying to make you do more.

Our divorce decree only states that the NCP gets "regualr and frequent time". I don't have a lawyer, I'm in the process of finding one to get a more specific CO in place.

Thanks everyone for the support. It's good to hear that you aren't the crazy one. hahaha
