Thank you for contacting me regarding the adoption tax
credit. I am pleased to hear from you on this issue.
As you may know, Congress, with my strong support,
first approved the adoption tax credit in 1996. The original credit was
for qualified expenses of up to $5,000 per adoption and $6,000 per adoption of
a special needs child. Then, in 2001, Congress passed the Economic Growth
and Tax Relief Reconciliation Act of 2001 (Bush tax cuts, P.L.107-16), which
increased the credit to $10,000 for all adoptions until the law expired at the
end of 2010. The increased adoption tax credit was subsequently extended
through 2012, by The Tax Relief, Unemployment Insurance Reauthorization, and
Job Creation Act of 2010 (P.L. 111-312), which I also supported.
Most recently, Senator Mike Johanns (R-NE) introduced the Adoption Tax Relief
Guarantee Act (S. 82), which would make the $10,000 adoption tax credit
permanent. This bill is currently pending consideration before the Senate
Committee on Finance.
I appreciate and understand the valuable incentive the
adoption tax credit provides to families, which is why I have been a strong
advocate for making adoptions easier and less financially burdensome.

It is very possible that this legislation will move in some form at the very end of the year during the "lame duck session" that takes place in November and December. I know this because I work in the Senate. This is one of those issues that we will not take up by itself, but will likely be able to roll into a larger bill. We do that often times because we do not have a lot of time at the end of the year, but it is a source of frustration because it is easy to stick stuff in larger bills that people don't like. (Obviously, I'm using technical terms here!
)
That being said, I get the general feeling that this particular tax credit is one we want to grant, it will just be something we work on in the context of a larger bill. I'm keeping a close eye on it, you can be assured.

In the meantime, tell everyone you know to write to their Senators and Representatives asking them to cosponsor and support the tax credit. The more people who write in, the more likely it is the Members will act on it. (Think squeaky wheel gets the grease!)
