Anbody in NY? questions on Mat leave benefits

This is my second baby, with the first I was told by my employer that my leave would be paid just by my vacation/ sick time. That I didn't get disability b/c it wasn't offered by my employer. I even called the state to inquire.

Well, I've researched this a little differently and came across this...

Apparently, NY is one of the 5 mandated states for offering disability.  Did something change in the past two years with maternity leave? 

Also, my employer HR told me had 120 days until my health insurance was cut off. Well, the last time it was 90 days until cut off. My HR rep isn't real direct with answers when I ask all of my questions.

  • Your EMPLOYER doesn't offer short term disability, so they are correct there.  It is an insurance policy you buy into throught the state.  Check your paystub and you should see a small amount coming out for disability.  There are some restrictions, but as long as you haven't opted out of this, you are covered.  You would be paid for 5 weeks at half of your pay, and be entitled to six weeks of job-protected leave.  Otherwise, nothing is paid unless your employer includes that as a benefit (most don't).  HTH.

  • I'm not in NY, but I might have a guess? You say that in NY they are mandated to "offer" a disability benefit. My question would be, can they still require that you (as the employee) pay for the benefit? If so, do you pay for it out of your check? I am only saying this because I know my husband's work "offers" STD, but he does not opt-in and pay for it. That could be where the miscommunication is, especially if your HR person doesn't explain things very well. Other than that, I am not sure what could be happening. Also, not sure what you mean about your health insurance "cutting off"??

  • If you need extra time and your employer isn't exempt (most aren't) you can also use FMLA time. It doesn't guarantee pay, but you get up to 12 weeks of job protected leave. It's federal law.

  • I live in New York, but also am only able to use the time I have saved up for paid leave, anything beyond that is unpaid through FMLA.  Short term disability is not offered through my job since I work for the government (and that is one of the employers exempt from offering it).  There are a few other types of jobs that are not covered by short term disability in NY, so maybe your job falls into one of those categories?  If you can't find an obvious reason as to why your job doesn't offer short term disability, I would ask your HR person very directly about it.
  • I'm in NY too and am using my vacation time plus the 6 weeks of STD my employer's plan offers. That's it. Moving back across the pond is sounding really good.
