CA Child Support question

I just sent of my paper work to child support services, we have a court ordered agreement but he didnt pay me this month so Im going to go ahead and work it through the state. Does anyone know what happens next? Will they automatically garnish his wages or give him the option to pay first? They did tell me they would not open a case for 20 days but I just want to know what happens next. TIA

  • I'm curious what others have to say. I tried going through the state first...and got a judgement for $0 a month. Didn't even know that was possible. Spent an afternoon in the CSS office only to have them tell me they can't find his money so I have to hope the court orders him to pay. Thanks California!

    Well we have a court ordered agreement so hopefully the amount won't change :)

  • If it's a court ordered agreement, he is going to be in big trouble. How late is he on paying you? Have you tried contacting him? My XH and I decided not to go through CSS, because he agreed to pay me -- per our court ordered agreement. I think as long as he has a job, his wages will be garnished. His option to pay you was broken if he didn't through your court ordered agreement. I'm hoping my situation doesn't come to this, but you never know...
  • If you already have a CO regarding CS, then DCSS will ask you for all of BD's info (home address, work info, etc).  They'll send him a letter notifying him that they are now handling the matter and will send out letters to his employer to confirm that he works there.  Once his employment is confirmed, they'll send out the CO for wage garnishment.  It's actually great to go through them (even though it causes headaches at times) because if he falls behind on payments or switches employment to make it hard for them to locate him, they'll levy bank accounts and intercept his tax returns. 

    DCSS is a little slow at first, but once they have all the paperwork done and his info in the system, they really stay on top of everything.

  • It is definatly court ordered and this is the first month he has failed to pay. Ive sent DCSS all the info I had on him (pretty much his social and address)

    we had been doing great with him just paying me until he decided he didnt want to, I do think this will be best and thank you for the great answers! Im thinking since we have 17 more years of this I may as well get on the straight and narrow.

  • I am in CA and was told nothing would really happen for at least 6 months.  I am going into month 5 and so far its been true. As far as the amount he owes you, from what I can tell it plays little role in actually getting paid.  My EX owes me around $45k in back CS and nothing has happened to him what-so-ever.
