Out of state relocation?

Has anyone been successful in obtaining a court order allowing out of state relocation where the father is in opposition? TIA!

 

ETA:  Just some background: I'm attempting to obtain temporary relocation to Texas from Florida (and eventually permanent relocation). On paper, I earn more than my STBX (he runs his family business, not sure what the business earns because he has refused to disclose it to me). I have two small children and another due in September. Since we have been married, he has never lived in the marital residence, instead he has resided at his place of business (100 miles away) and comes home once a week on average for a few hours (please dont flame, i know this was a messed up situation hence the divorce). He obviously has not been involved in the child rearing. Also, I have no family in Florida. My parents reside in Texas and would be a huge help for me. I am currently unemployed, but I am in the process of applying to the Texas Bar. I hope a court will see that it is in the best interests of my children for relocation given my circumstances.

    What state were you living in if you don't mind me asking? What were you arguments for out of state relocation? How long did the process take? TIA!

    I just got done talking to my lawyer about this. It has to be for a significant change in salary (5% or so), benefits, education, or for support purposes, IE your family is there. And, you have to show you're not trying to block the fathers access and how you're willing to make access possible. Ex, I'm limited to my county for now, but I can show Im better able to support myself and my child in another city (I may 19/hr here and can make 23/hr in Dallas or 25/hr in Houston). Also, if we meet half way, a 1st, 3rd, and 5th visitation schedule is still possible. Or, that's flights are only an hour long and can start at age 5. 

    To move out of state, itd have to be MAJOR, but TX is really big. To move out of country... Well, I have dual citizenship, so I'd probably always lose that battle.

    What is your geographical restriction? Is it state, metro, or county? If you can show he's had little to no access and you have family support in TX, then odds are high in your favor. If he doesn't live in the geographical zone, then the restriction is usually null and void. (If SD moves out of the county, then the restriction is void.) If you don't have one, you can do whatever you want.

    he resides several counties away from our marital residence.
