Power of Attorney advice?

Hey all-

I'm a super newbie, as my DH is about to leave for Navy OCS in a month. I have been told to secure a POA and a friend suggested doing it online with LegalZoom.com, but another person told me that it wont be the right kind of POA, and that I should talk to a Navy attorney. Since I am in the middle of the Colorado mountains, finding a Navy attorney is near impossible, so I am wondering what my next step is in this whole process. Any advice is greatly appreciated!

  • you can go to any military base and go to their legal office or you can write one up and have it notarized. he can also probably get one when he is at officer school and send it to you

    Dx: Complete septate uterus with cervical duplication, endometrial polyps, PCOS, endometriosis, hypo thyroid, luteal phase defect
    4 uterus surgeries to correct my complete septum and to remove polyps and 2 years of seeing the RE, medicated cycles and IUIs
    Baby 1 and 2: BFP 3/3/11 with 2 babies EDD 11/1/11, M/C 4/6/11
    Baby #3: 8/11 pregnant EDD 4/27/11 and m/c:(
    Baby #4: 10/12/11 BFP! EDD 6/16/12m/c 10/26/11
    Baby #5: 3/13/12 BFP! EDD 11/25/12 ANOTHER m/c :(

    Baby #6: 2/14/13- BFP! EDD 10/24/13, CP 2/19/13
    Baby #7: 3/15/13- BFP! EDD 11/27/13, another CP
    Baby #8.  BFP 5/19/13 EDD 1/22/14. 8 was not our lucky number

    4th septum resection on 5/31/13.
    Baby #9: 6/29/13 BFP. C section scheduled for March 5th!

    My miracle baby was born March 5 at 9:33am. He was 8 lbs 12.5 oz and 21.25 inches long!

    My hubby has never had an issue getting one and sending to me! Even on a ship in the middle of the ocean! And as long as everything (bills, lease, CC, etc) is in your name it should not be an issue! :o)


    Started TTC in 2006, LOTS of trying, and trying, and 7 rounds of IVF with 13 embryos, 2 perfect little boys and 5 loses....
    All finished with babies, started to make diet changes, Keto, to be MORE for my kids, lost 30 pounds, still going, and 3 months in, I had a natural cycle, and then ovulated... Hubs and I are going to see what happens now... Maybe a natural pregnancy? After everything we have been through? Or just a return to normal hormones? We shall see what the future holds!

    My DH gets us a couple of POAs each time he deploys, he just has to go talk to legal and they'll get it set up for him.  I'm not sure but you may not be able to get the POA without your DH around anyway, so it couldn't hurt to let him talk to legal wherever he is and secure it for you.  Some people recommend a general POA, but you are definitely going to need a specific financial POA if you're going to be handling money matters that would normally require your DH's signature.  We were warned that a lot of banks/financial institutions will no longer accept a general POA. We weren't too worried about needing a financial POA for the first deployment, but I'm very glad I had it because I had to move unexpectedly and having it on hand saved us a lot of headaches in regards to the leases.

    On a sort of related note, it probably won't be an issue since your DH is only going to OCS right now and not deploying, but when mine went to get the POAs he also made sure to update his living will.

    This. My hubs mailed me an updated one from Afghanistan. Pretty sure he can get you one with no trouble.

    Mine even scanned it and emailed it to me and I haven't had any problems.

  • My husband is leaving for Air Force OTS next week, and we just got our POA.  We don't have any AF base near us, but we live close to West Point (Army).  He went there and they helped him.  When I called the Legal Assistance office at West Point, the lady said that technically DH needs to have a military ID for her to help him, but she didn't really care and would help anyway :)  I didn't need to be present for it to be completed.  It is a one pager that he signs and she notorizes.  You can find POA's for your state that you can complete and have notorized, but I just felt more comfortable having one done by the military so there was no snafu's later on.  

     Do you have any military bases near you?  If so, start there.  If not, see if it will be possible for you DH to do it when he gets to OCS and then mail it to you.  Maybe his recruiter could help you obtain the form that the military uses, and then you guys can take it to a notary to complete?
